Tuntutan royalti: Tindakan akhir guna mahkamah - Nik Aziz

Kerajaan Kelantan tidak menolak kemungkinan menyelesaikan isu tuntutan royalti minyak ke mahkamah sekiranya rundingan gagal antara kedua-dua pihak.

Menteri Besar, Tuan Guru Dato' Nik Abdul Aziz Nik Mat berkata, sekiranya usaha penyelesaian cara rundingan dengan kerajaan pusat buntu, kerajaan negeri tidak teragak-agak mengambil tindakan melalui undang-undang.

Malah kata beliau sekiranya mahkamah tempatan tidak juga dapat menyelesaikan tuntutan itu, ia mungkin akan dibawa ke mahkmah antarabangsa.

"Bagaimanapun sebelum tindakan akhir dibawa ke mahkamah kerajaan negeri akan menyelesaikan secara rundingan dengan kerajaan pusat bagi mendapatkan royalti.Image

"Sekarang masih ada jalan mudah iaitu rundingan, maka tiada sebab kenapa ia perlu diselesaikan di mahkamah pada peringkat ini," ujarnya ketika ditemui selepas merasmikan sambutan Hari Yayasan Islam Kelantan (Yik) di Pusat Tarbiah Islamiah Kelantan hari ini.

Baru-baru ini Menteri Besar menghantar surat tuntutan royalti minyak kepada Perdana Menteri memandangkan terdapat pelantar carigali yang di kawasan perairan Kelantan.

Bagaimanapun surat tersebut belum dijawab perdana menteri sehingga sekarang.

Sebelum ini Petronas Carigali Sdn Bhd mengadakan usahasama dengna Shell Exploration dan Production Malaysia B.V menemui gas di Blok PM301 yang difahamkan terletak dalam kawasan perairan Kelantan.

ImageTelaga Bunga Anggerik 1 memulakan penerokaan pada 21 November 2004 dan telah menggerudi sedalam 1,527 meter dan menemui empat zon gas.

Mengenai kenyataan veteran Umno, Tengku Razaleigh Hamzah yang berhujah Kelantan berhak mendapat royalti berkenaan Menteri Besar berkata, beliau bersyukur di atas keprihatinan bekas Menteri Kewangan itu.

"Tengku Razaleigh yang juga bekas Pengerusi Petronas memang mengetahui perkara sebenar dan sedar akan hak Kelantan," ujarnya.

Tuan Guru Nik Abdul Aziz juga melahirkan rasa tidak puas hati terhadap cadangan Kementerian Pelajaran yang cuba menghadkan 10 subjek sahaja bagi calon SPM bermula tahun depan.

Katanya, tindakan itu secara tidak langsung mencantas daya saing seseorang manusia di samping merugikan masyarakat.Image

"Tindakan berkenaan merugikan bukan sahaja pelajar sebaliknya masyarakat memandangkan pelajar hari ini pelapis pemimpin pada masa depan.

"Antara sedar atau sebaliknya kerajaan pusat telah mematikan hasrat di kalangan pelajar yang mempunyai semangat berlumba bagi mencapai kecemerlangan dalam pelajaran," katanya

Menurutnya semangat ingin berlumba di kalangan pelajar perlu disemai serta dibajai dari awal lagi.

Pada sambutan itu anggota parlimen Pengkalan Chepa, Dato' Abdul Halim Abdul Rahman diumumkan Tokoh Pendidikan Yik 2009.

Dengan anugerah itu beliau mendapat tiket mengerjakan umrah dan sijil penghargaan yang disampaikan Menteri Besar.

Hartal is a term in many Indian languages for strike action, used often during the Indian Independence Movement. It is mass protest often involving a total shutdown of workplaces, offices, shops, courts of law, etc., as a form of civil disobedience. In addition to being a general strike, it involves the voluntary closing of schools and places of business. It is a mode of appealing to the sympathies of a government to change an unpopular or unacceptable decision.

Hartal was originally a Gujarati expression signifying the closing down of shops and warehouses with the object of realising a demand. MK Gandhi, the Indian national leader from Gujarat, organised a series of anti-British general strikes, which he called hartals, thereby institutionalising it.

In Bangladesh a hartal is a constitutionally recognised political method for articulating any political demand.

In Sri Lanka, it is often used to refer specifically to the 1953 hartal of Ceylon. Hartals are still common in India, Bangladesh and in northern and eastern Sri Lanka.

In Malaysia, the word "hartal" was used to refer to various general strikes in the 1940s, 50s and 60s, such as the All-Malaya hartal of 1947 and the Penang hartal of 1967.

The recent Manik Urai by-election proved even more that Barisan Nasional, in particular Umno, depends on money for its survival. RM1,000 in cash was paid to every voter in Manik Uria, resulting in Pakatan Rakyat almost losing the by-election. One just can’t ignore the power of money. And money is one thing that Barisan Nasional has plenty of. Plenty of money would translate to plenty of power as well.

To cut Barisan Nasional and Umno down to size, we have to hit them where it hurts most. And it hurts most when the pocket is hit. So, to hurt Barisan Nasional and Umno, we must hit them in the pocket. And this means hitting the source of that money, the companies that are paying Barisan Nasional and Umno huge sums of money to help them stay in power.

Who are these crony companies? Which are the companies that are paying Barisan Nasional and Umno huge sums of money? Where did all this money come from? How much of that money actually belongs to you and me, the rakyat?

Companies are in the business of making money. You do not set up a company to do charity. Companies have only one philosophy in mind and it can be summed up in just three words: profit, profit, profit.

So we need to reduce the profit of these companies. We need to cut into their war chest so that they have very little left to give to Barisan Nasional and Umno. Companies depend on licences, permits, quotas, government contracts, political patronage and whatnot to survive. And to procure these licences, permits, quotas, government contracts, political patronage and whatnot, they need to pay ‘under the table’ money to those who walk in the corridors of power. Bribery makes the world go round in corporate Malaysia. Bribery fuels the government machinery. Business empires are built on bribery, corruption, political patronage and cronyism.

Look for alternatives. Buy products and services from those that are not crony companies. Deny yourself whatever it is you normally indulge yourself in so that these companies do not earn your money, which in the end ends up in the pockets of Barisan Nasional and Umno.

Another way to hurt them financially would be to launch a hartal. On 8 August 2009, a few NGOs and civil society movements are organising a hartal in Perak. They want to turn Perak into a ‘ghost town’. Stay home on 8 August 2009. Don’t leave your house. Empty the streets, shops and restaurants. Do what you need to do the day before. And on 8 August 2009 stay behind the locked doors of your home.

On 31 August 2009 we shall, again, be celebrating Merdeka or Independence Day. Independence was declared on midnight of 30 August 1957. On that day the Union Jack was lowered and proudly replaced with the Malayan flag.

But are we truly independent? Or did we just switch the white British colonialists with brown colonialists? Did we merely kick out one dictator, ten thousand miles away, and replace it with ten thousand dictators one mile away?

No, we are not yet Merdeka. What we have done is merely to replace one colonial government with another. The present government is continuing the oppression and discrimination of the previous government. We need to be truly Merdeka by ending the dictatorial rule of the present government.

There is no reason to celebrate Merdeka. There is no justification to raise the flag this 31 August 2009. Merdeka has not been achieved yet. It will only be achieved when we see a change in government or at least a change in government policy. Only then would it be feasible to celebrate Merdeka.

We need a hartal. We need many hartals. The rakyat need to vote with their feet. They rig the ballot box. Voting with our ballot paper is an uphill task. We must use our feet to vote. And the way to vote with our feet would be to launch and participate in many hartals and boycotts.

Civil disobedience is the order of the day. If we stay home and refuse to buy the products and services of those who are propping up the illegitimate regime the government will eventually crumble. Without our participation the government can do very little. Without our money we will starve them.

If we come out and protest they can use the police against us. If we demonstrate they will brutalise us. But they can’t do anything to us if we launch a hartal. No government can clamp down on civil disobedience.

So do nothing. No one can harm you if you do nothing. And doing nothing involves staying home and not allowing your money to leave your pocket. And if you still need to buy products and services make sure it is not from one of the crony companies.

SPRM Langgar Undang- Undang Siasat Saksi Lebih Masa


Ahli Parlimen Klang, Charles Santiago berkata Malaysia sedang menuju sebuah negara gagal berikutan ketidakmampuan pihak berkuasa menangani korupsi dinegara ini.

Beliau menambah Suruhanjaya Pencegahan Rasuah Malaysia (SPRM), sebuah badan yang dipertanggungjawabkan untuk menangani korupsi, kini mengalami krisis parah kerana dilihat sering diperkuda oleh parti pemerintah untuk memenuhi agenda politik UMNO- BN.

Badan kerajaan itu cuba memulihkan keyakinan rakyat dengan menukar nama dari Badan Pencegah Rasuah (BPR) kepada Suruhanjaya Pencegahan Rasuah Malaysia (SPRM).

Namun prestasi yang ditonjolkan SPRM akhir- akhir ini memualkan rakyat dengan tindakan mereka menghalalkan cara melicinkan strategi UMNO Barisan Nasional menumbangkan kerajaan Pakatan Rakyat di Selangor.

16 Julai lalu, SPRM mengejutkan banyak pihak berikutan kematian misteri Setiausaha Politik Exco Kerajaan Negeri Selangor, Teoh Beng Hock yang menjadi saksi kepada dakwaan salah guna wang peruntukan DUN negeri Selangor.

Teoh dikatakan disoal siasat hampir 10 jam bermula jam 6 petang sehingga jam 3.45 pagi. Pemerhati politik dan orang ramai mempersoalkan mengapa SPRM bertindak sedemikian walhal mereka hanya diperuntukkan masa bermula 8 pagi sehingga 8 malam sahaja.

"SPRM tidak menggunakan cara- cara dan tatatertib yang betul yang telah diperuntukkan oleh undang- undang. Satu yang telah dilanggar oleh SPRM adalah semua saksi perlu dilepaskan sebaik saja pukul 8 malam," kata Charles.

"Seseorang yang disoal siasat mesti sebelum pukul 8 iaitu selepas pukul 8 tak boleh soal siasat," tambahnya lagi.

Santiago mengulas pendedahan yang dibuat bekas pegawai SPRM, Mohamad Ramli Manan yang mengatakan SPRM telah melanggar undang- undang kerana menahan dan menyoal siasat saksi melebihi masa yang telah ditetapkan.

Mohamad Ramli Manan merupakan Timbalan Pengarah BPR yang kini dikenali SPRM di negeri Kedah, Perak dan Negeri Sembilan sebelum dilantik menjadi Pengarah BPR di Kelantan, Melaka, Johor dan Sabah.

"Mengenai mendiang Teoh, dia telah disoal siasat dari pukul 6 petang sehingg 3.45 pagi. Tapi bukan dia saja. 3 minggu seorang wartawan Malay Mail telah disoalsiasat dari pukul 5 sehingga pukul 3 pagi. Cik Manan kata ini cara baru yang digunakan oleh SPRM yang membelakangkan peruntukan oleh kerajaan persekutuan," dedahnya lagi.

Santiago hanya tergelak sinis apabila diajukan soalan mengenai siapakah yang bertanggungjawab mengambil tindakan kepada SPRM yang secara terang- terangan melanggar peruntukan yang ditetapkan oleh kerajaan pesekutuan.

"Ini soalan bernilai 100 juta dolar Amerika. Sebenarnya sekarang, tidak ada keyakinan rakyat pada SPRM yang tulus dan berkecuali. Oleh sebab itu apa- apa perubahan yang mereka buat tidak mendapat keyakinan rakyat. Sebenarnya ada undang- undang yang menentukan apa yang SPRM boleh buat dan apa yang tidak boleh mereka buat," ujar Charles.

"Kita mesti menggunakan kuasa rakyat. Dimana semua rakyat dan badan- badan belia, persatuan pekerja, rukun tetangga, badan- badan NGO dan sebagainya dan badan- badan politik mesti menekan pihak SPRM supaya menjadi telus," katanya.

Sementara itu, TV Antara turut menghubungi Ahli Parlimen Kapar, S. Manikavasagam yang pernah menjadi mangsa soal-siasat SPRM sehingga ke awal pagi keesokan harinya.

Sepanjang tempoh soal- siasat itu, beliau dikurung dalam bilik tanpa penghawa dingin dan disoal sehingga jam 2 pagi. Sepertimana Teoh, beliau juga dipanggil ke SPRM sebagai saksi.

"Dia patut ada undang- undang untuk tetapkan waktu siasatan untuk ambil kenyataan. Di pejabat SPRM Shah Alam pukul 2 3 pagi sudah tidak ada pengahwa dingin. Ini salah guna kuas," ujar Manikavasagam.

"Saya dipanggil sebagai saksi untuk memberikan keterangan tapi saya disoalsiasat sampai pukul 2 pagi," tambahnya lagi.

"Dibawah akta polis, polis ada kuasa untuk siasat seseorag dari pagi pukul 8 sampai pukul 6 petang. Bila saya persoalkan SPRM mengapa saya ditahan sehingga jam 2 pagi pihak mereka tidak boleh jawab," katanya.

ISA: Mengapa Majlis Fatwa tidak berani?

Majlis Fatwa Kebangsaan tidak berani mengeluarkan fatwa isu-isu berkaitan kezaliman yang sah bercanggah dengan nas al-Quran dan hadis seperti mana Akta Keselamatan Dalam Negeri (ISA).

Naib Presiden PAS, Dato' Tuan Ibrahim Tuan Man berkata, Majlis Fatwa harus ada keberanian mengeluarkan fatwa dalam isu yang berkaitan kezaliman disamping memastikan fatwa itu dipatuhi.

Kata beliau, mereka sepatutnya memberi panduan kepada rakyat dalam urusan-urusan yang melibatkan hukum.

Malangnya, kata beliau banyak fatwa yang dikeluarkan Majlis Fatwa tidak ada tindakan yang diambil.

"Fatwa yang dikeluarkan oleh Majlis Fatwa tidak ada kekuatan sebagai contoh fatwa melarang memberi penghormatan di Tugu Negara, kalau pemimpin buat pun tidak ada tindakan apa-apa," katanya semasa dihubungi.

Tegasnya, Majlis Fatwa Kebangsaan sepatutnya sudah ke hadapan dalam memberi panduan kepada pemimpin tetapi yang lebih penting daripada itu ialah pemimpin mesti ikut mereka supaya integriti Majlis Fatwa itu dapat dipelihara.

Tambahnya, kaedah Islam telah menentukan bahawa seseorang itu tidak dianggap bersalah perlu diberi peluang untuk membela diri dan didakwa di mahkamah.

"Jadi dalam sejarah ISA sudah beribu umat Islam ditahan tanpa bicara, rakyat yang diseksa, ini dikatakan zalim.

"Saya rasa rakyat bukan suka sangat hendak berhimpun dan turun demonstrasi di jalanan tetapi bila hampir tidak ada jalan lain, apa yang kita tidak buat? Kita sudah hantar memorandum, ambil tandatangan orang ramai, kita adakan seminar dan bantahan jadi kemuncak kepada kemarahan kita akan menyerahkan memorandum melalui himpunan aman,"jelasnya.

Sehubungan itu, beliau yakin apa yang rakyat akan buat pada 1 Ogos nanti bukan satu suasana untuk mewujudkan kekecohan tetapi sekadar luahan rakyat yang berbilang agama dan kaum dalam isu-isu yang berlaku iaitu kezaliman ISA.

Apakah ini suatu yang wajar? Kenapakah tidak berlaku sebaliknya iaitu firma saya ataupun mana-mana rakan di dalam pasukan saya mendapat kerja daripada PKNS, PKINK ataupun Penang Development Corporation? Siapakah yang bersalah di dalam situasi ini?

Zaid Ibrahim & Co. is on the panel of most banks and GLC and yet they squeeze the Government to a point of no return.

If we do not put a stop to all these they will grow bigger and stronger and by then we will be too late to stop them. "

PAS Terengganu bersiap hadapi pilihan raya kecil


PAS berkeyakinan pilihan terakhir bagi menyelesaikan kemelut politik di Perak dan Terengganu sekarang dengan membubarkan Dewan Undangan Negeri (Dun) bagi membolehkan mandat baru rakyat diperolehi.

Presiden PAS, Dato' Seri Tuan Guru Abdul Hadi Awang berkata, krisis politik yang berlanjutan di kedua-dua negeri yang kini diterajui Barisan Nasional (BN) tidak mampu selesai tanpa diadakan pilihan raya.

"Kalau sebelum ini Perak disebut-sebut akan dibubarkan Dun dalam tempoh terdekat, masalah serupa juga berlaku di Terengganu," katanya�pada satu program di sini baru-baru ini.

Hadir sama Yang Dipertua PAS kawasan itu, Ustaz Wan Azhar Wan Ahmad.

Menurutnya krisis yang berlaku antara Menteri Besar, Dato' Ahmad Said dengan bekas menteri besar, Dato' Seri Idris Jusoh tidak boleh diselesaikan lagi.

Oleh itu beliau meminta jentera Pilihan raya PAS Terengganu bersiap sedia untuk menghadapi kemungkinan pilihan raya peringkat negeri dalam masa terdekat ini.

"Semua ahli dan penyokong PAS hendaklah mendekati semua lapisan masyarakat bagi menarik mereka menyokong PAS.

"Janganlah kita memusuhi mereka kerana semata-mata mereka menyokong Umno sebaliknya perlu berusaha menarik mereka," tambahnya.

Lawatan presiden merupakan sebahagian program memperkasakan PAS Besut. Program dua hari itu diadakan pada 24 dan 25 Julai lalu.

Hadir sama Timbalan Presiden, Ustaz Nasaruddin Mat Isa dan Ketua Dewan Muslimat PAS, Ustazah Nuridah Mohd Salleh.

PAS sekarang mempunyai lapan daripada 32 kerusi di Dun Terengganu.

Menteri Besar Kelantan, Tuan Guru Dato' Nik Abdul Aziz Nik Mat menegaskan bahawa hubungan yang terjalin sekarang ialah di antara Kerajaan Negeri dengan Kerajaan Persekutuan dan bukan hubungan dengan parti Umno.

"Hubungan negeri ialah dengan Kerajaan Pusat oleh kerana sistem yang diamalkan ialah sistem Federalisma, oleh itu tidak timbul hubungan dengan Umno,"kata Mursyidul Am PAS itu pada sidang media selepas melawat pameran ternakan di Padang Perdana dekat sini semalam.

"Kerajaan Pusat ada kewajipannya kepada Kerajaan Negeri dan Kerajaan Negeri pula ada kewajipannya terhadap Kerajaan Pusat, maka kenapa mahu disekat (hubungan itu).

"Kerjasama Kerajaan Persekutuan dengan Kerajaan Negeri hendaklah menyentuh isu penubuhan Jabatan Pembangunan Persekutuan (JPP) di Kelantan," katanya.

Dalam pada itu Nik Aziz berkata, tindakan parti lain di peringkat Pusat yang menghalang Kerajaan Negeri Pakatan Rakyat dari mendapat kemudahan daripada Kerajaan Pusat itu adalah tidak menurut Perlembagaan.

"Tidak terdapat dalam Perlembagaan dan tidak terfikir pada akal fikiran manusia bahawa negeri Kerajaan Pakatan Rakyat dihalang oleh parti lain di Pusat dari mendapat kemudahan sepatutnya.

"Kenapa peruntukan Kerajaan Persekutuan tidak diberi terus kepada Kerajaan Negeri sebagaimana dilakukan Kerajaan Pusat ketika Kelantan diperintah Umno dahulu. Kenapa kini ditubuhkan JPP?

"Apa kata kalau parti lain (Kerjaan Pakatan Rakyat) menguasai Pusat lalu menubuhkan juga JPP di negeri yang di perintah Umno, apa perasaan mereka," katanya sambil menyifatkan konsep Satu Malaysia dan demokrasi yang dilaung-laung bercanggah dengan tindakan dilakukan Umno Pusat ke atas Kerajaan Negeri.

Oleh itu katanya, selaras dengan peruntukan Perlembagaan Persekutuan, Kerajaan Pusat mesti membantu Kerajaan Negeri, dan urusan membantu mana-mana Kerajaan Negeri bukan dilakukan dengan sukarela, tetapi melalui peruntukan Perlembagaan.

"Kalau dia (Kerajaan Pusat) tidak buat juga, kita gulinglah. Pandailah kita guling.

"Terbaru, ada Menteri yang tidak mengizinkan pegawai dia di Kelantan ini bekerjasama dengan Kementeriannya. Itu bukan sifat seorang Menteri,"katanya.

Beliau turut menegaskan bahawa dasar perjuangan Umno dan PAS memang selamanya tidak sama.

"Umno memang tidak serupa dengan PAS, bahkan pada setiap kali diadakan pilihan raya sama ada Pilihan Kecil atau Pilihan Raya Umum, Umno tetap melawan PAS.

"Kerana apa Umno melawan PAS, setiap tahun sama ada pilihan raya kecil atau pilihan raya besar sedangkan sekiranya di dunia ini tidak ada Umno, (andai kata), orang Melayu boleh hidup molek, bahkan Islam itu sendiri boleh berkembang dengan baik, tegasnya

Menteri Besar turut mengulas perkembangan mutakhir mengenai surat yang dihantar kepada Perdana Menteri Dato' Seri Najib Razak bertujuan untuk bermujadalah.

"Menerusi surat itu, saya bertanya dia kenapa Umno menolak Islam dan menggantikannya dengan 'Kebangsaan'.

"Dan kenapa Umno melawan PAS. Di mana tidak kenanya kedudukan PAS khususnya dari segi agama dan Perlembagaan. Di mana tidak kena kedudukan PAS dengan Perlembagaan Persekutuan.

"Sehingga kini dia tidak jawab-jawab pun (surat itu)," katanya.

Dalam perkembangan politik semasa, beliau turut mengulas tindakan meninggalkan parti oleh anggota pimpinan Umno-BN termasuk mantan Menteri Kesihatan dan bekas Naib Presiden MCA Dato' Chua Jui Meng dan mantan Naib Presiden MIC, Dato'S S Subramaniam.

Kedua-dua mereka memasuki Parti Keadilan Rakyat (KeADILan).

Terdahulu mantan Menteri Di Jabatan Perdana Menteri yang juga mantan Ketua Umno Bahagian Kota Bharu Dato' Zaid Ibrahim memasuki KeADILan.

"Insya-Allah, ramai lagi orang Melayu, Cina dan India yang sedar, mereka akan meninggalkan Umno-BN," katanya.

Beliau mempertikaikan cadangan bekerjsama dengan Umno walaupun ada dakwaan bahawa dengan itu akan lebih memudahkan lagi kerjasama antara pemerintah.

"Umno sekarang sudah tidak ada maruah. Nak minta bekerjasama dengan orang PAS). "(Tetapi) waktu kamu gagah dahulu kamu tendang aku (PAS) (keluar daripada Kerajaan Pusat). Saya ingat perkara itu," tegasnya sambil mengingatkan bahawa PAS menyertai Kerajaan Pusat ketika itu dengan jemputan daripada Tun Abdul Razak sebagai Perdana Menteri.

Polis beri amaran batalkan perhimpunan ISA

Polis memberi amaran tegas terhadap pihak pro dan anti-ISA supaya membatalkan rancangan mereka untuk mengadakan perhimpunan Sabtu ini.

Ketika memberi amaran tersebut, Ketua Polis Kuala Lumpur, , Datuk Muhammad Sabtu Osman (kiri) berkata, perhimpunan itu dikhuatiri menimbulkan ketegangan dan mengancam keselamatan awam.

Menurutnya, polis telah memanggil Majlis Permuafakatan Ummah (Pewaris) semalam untuk memaklumkan mengenai arahan tersebut kepada mereka.

Manakala polis juga, katanya, akan bertemu dengan Gerakan Mansuhkan ISA (GMI) petang esok untuk memaklumkan perkara yang sama.

Polis juga, katanya, akan mengadakan sekatan jalanraya dua hari lebih awal dan akan menahan bas-bas disyaki membawa pesertai ke perhimpunan itu.

Sebelum ini, Pewaris dan sepuluh lagi NGO Melayu yang pro-ISA, merancang berdemonstrasi Sabtu ini di ibu negara, serentak dengan perhimpunan besar anjuran Gerakan Mansuhkan ISA (GMI) dan pakatan pembangkang.

Bercakap dalam satu sidang akhbar di ibupejabat polis kontinjen Kuala Lumpur petang ini, Datuk Muhammad Sabtu berkata polis mengkelaskannya sebagai satu perhimpunan haram di bawah Seksyen 27 (5) Akta Polis 1967.

Polis juga, tegasnya, akan mengambil tindakan mengikut Seksyen 141 Kanun Keseksaan atau undang-undang lain sekiranya ada pihak yang mengambil bahagian dalam perhimpunan tersebut.

Menurutnya, pihak polis telah bersedia dengan kekuatannya untuk memfokuskan kepada perhimpunan itu jika diadakan juga.

"Polis akan mengambil tindakan berhemah, kecuali tidak ada cara lain. Polis tidak ingin melihat berlakunya kecederaan, luka atau dalam keadaan yang terdesak," tegas Datuk Muhammad Sabtu.

Ditanya sama ada polis akan membuat tangkapan awal bagi mengelak perhimpunan tersebut, beliau berkata:

"Sebagai langkah pencegahan, polis boleh mangambil tindakan awal mengikut Seksyen 105, Kanun Acara Jenayah, jika nampak niat, pergerakan walaupun sehari sebelumnya," katanya.

GMI teruskan demo, Pewaris ikut

Majlis Permuafakan Ummah (Pewaris) akan meneruskan hasratnya untuk mengadakan demonstrasi menyokong ISA sekirannya kumpulan penentang ISA - Gerakan Mansuhkan ISA (GMI) - meneruskan perhimpunan mereka Sabtu ini, walaupun polis memberi amaran supaya mereka membatalkannya.

Manakala GMI pula, ketika dihubungi Malaysiakini, berkata perhimpunan yang dirancangkan itu akan tetap diteruskan Sabtu ini.

Pewaris dan GMI menegaskan demikian ketika diminta mengulas amaran keras Ketua Polis Kuala Lumpur, Datuk Muhammad Sabtu Osman supaya mereka membatalkan perhimpunan tersebut.

Dalam sidang akhbarnya hari ini, Muhammad Sabtu berkata ia dikhuatiri menimbulkan ketegangan dan mengancam keselamatan awam, di samping ia merupakan satu perhimpunan haram.

Katanya, beliau telahpun memanggil Pewaris semalam untuk memaklumkan perkara itu manakala pihaknya akan menemui GMI esok.

Sementara itu, Timbalan Presiden II Pewaris, Rahimuddin Md Harun berkata, mereka hanya akan membatalkan perhimpunan itu sekiranya GMI sebagai kumpulan yang menentangnya, turut mengambil tindakan yang sama.

"Kita akan teruskan (perhimpunan itu). Kalau GMI tarik diri, baru kita tarik diri. Perjuangan rakyat bukan pada polis saja, kita cuma hendak pertahankan hak kita," katanya kepada Malaysiakini hari ini.

Minta polis timbang semula

Manakala Pengerusi GMI, Syed Ibrahim Syed Noh pula berkata, pihaknya berpendirian, perhimpunan itu sejak awal lagi tidak bertujuan untuk mencetuskan huru-hara.

"Setakat ini kita masih setuju teruskan. Ini hak rakyat berhimpun secara aman. Mungkin kehendak kumpulan satu lagi (pro-ISA) yang menyebabkan polis ambil tindakan itu.

"Kita mahu berhimpun secara aman, kita telah keluarkan panduan kepada peserta kita," katanya ketika dihubungi Malaysiakini petang ini.

Sehubungan itu, Syed Ibrahim berharap pihak polis dapat menimbang semula arahan tersebut atas semangat demokrasi.

Ditanya mengenai kenyataan ketua polis Kuala Lumpur untuk menemui GMI esok berhubung arahan tersebut, beliau berkata:

"Ianya tidak perlu sebab kita telah maklumkan (kepada polis)".

Anwar, pemimpin PKR Turun Ke Himpunan Mansuh ISA

Ketua Umum Parti Keadilan Rakyat Anwar Ibrahim bersama semua pimpinan kanan PKR akan turun menyertai Himpunan Mansuh Akta Keselamatan Dalam Negeri (ISA) sebagai tanda solidariti kepada tuntutan memansuhkan akta zalim itu.

Setiausaha Agung Dato Salehuddin Hashim berkata PKR menyokong penuh perhimpunan rakyat yang akan dianjurkan 1 Ogos nanti kerana akta lapuk penjajah British itu disalahguna pemerintah sebagai alat mengancam dan mengugut rakyat Malaysia.

"Akta ISA ini adalah tiket jahat untuk kerajaan Umno-BN memastikan mereka terus berkuasa. Ia mencemar keluruhan Perlembagaan Malaysia dan mencemar kedaulatan undang-undang. Kerajaan Umno-BN menangkap sesiapa-sahaja sesuka hati tanpa waran, tanpa bicara dan tanpa hak guaman, menyebabkan berlakunya pelbagai penyeksaan fizikal dan mental," tegas Salehuddin.

Beliau berkata bantahan rakyat menentang akta ganas dan zalim adalah kesinambungan perjuangan yang sudah berlarutan sekian lama, dan komitmen kepada perjuangan itu akan dizahirkan oleh Anwar dan seluruh warga kepimpinan PKR dalam himpunan 1 Ogos nanti.

"Semua pimpinan tertinggi, anggota parti akan hadir bersama Ketua Umum Anwar Ibrahim menyatakan pendirian parti menentang undang-undang zalim," kata Salehuddin.

Jenayah Parah, Rasuah Berleluasa Musa Gagal Sebagai KPN

Ahli Parlimen Pakatan Rakyat hari ini dalam satu mesyuarat bersama badan bukan kerajaan bersetuju dengan empat resolusi meningkatkan keselamatan negara.

Ketua Umum Parti Keadilan Rakyat Datuk seri Anwar Ibrahim berkata, resolusi pertama mendesak tempoh perkhidmatan Ketua Polis Negara Musa Hassan tidak dilanjutkan ekoran kegagalan beliau sebagai KPN untuk mengurangkan kadar jenayah di negara ini sepanjang tiga tahun lepas.

Musa gagal dalam menjalankan semua peranan asas polis termasuk mengurangkan kadar jenayah, membendung rasuah dan melindungi hak asasi manusia.

Katanya, resolusi kedua mendesak perlantikan KPN yang baru yang komited kepada demokrasi, serta melaksanakan saranan Suruhanjaya Diraja Keatas Penambahbaikan Pasukan Polis seperti penububuhan Suruhanjaya Aduan dan Salahlaku Polis (IPCMC).

"Ketiga, KPI pembasmian jenayah berdasarkan kategori jenayah yang diusulkan oleh laporan Tun Mohamed Dzaiddin pada tahun 2005 dan yang keempat meminta diwujudkan Suruhanjaya Bebas Aduan dan Salahlaku Polis (IPCMC)," katanya.

Penubuhan IPCMC dicadangkan oleh Tun Mohamed Dzaiddin untuk memulihkan keyakinan umum terhadap pegawai polis.

Anwar berkata, pembaharuan yang diminta dalam resolusi berkenaan jelas bukan sahaja mahukan penubuhan IPCMC dan penukaran KPN baru tetapi juga melantik KPN yang bersih dalam usaha menambahbaik institusi polis dan profesionalisme mereka.

"Resolusi isu KPN ini serius dan kadar jenayah meningkat dan pertuduhan terhadap beliau begitu banyak, tindakan beliau membelakangkan hukum. Kami ada kepercayaan imej polis masih boleh dipulihkan ada sesetengah polis yang tahap profesionalisme mereka boleh membantu untuk memulihkan," katanya.

Anwar berkata, pembaharuan dalam institusi polis perlu bagi mengekang polis terlibat dalam jenayah termasuklah sindiket jenayah ah long dan samseng.

Katanya, sekiranya kerajaan tidak mengambil tindakan terhadap resolusi berkenaan, pihaknya akan memberi penjelasan kepada masyarakat mengenai jenayah membabitkan polis.

Sementara itu, Penasihat DAP Lim Kit Siang berkata, Pakatan meminta Barisan Nasional menerima resolusi berkenaan untuk melantik KPN baru dan modus operandi yang baru.

Katanya, langkah berkenaan perlu supaya polis memberikan layanan yang baik kepada rakyat, menjaga hak asasi manusia dan mengurangkan kadar jenayah.

"Perdana Menteri bercakap mengenai KPI Polis, saya gembira dengan pengumuman itu tetapi apa yang penting mereka perlu menyelesaikan masalah pokok dan perkara pertama yang akan dilihat adakah terdapat lantikan KPN baru, jika tidak saya rasa semua cakap-cakap mengenai KPI polis akan menurun dan ramai yang hilang kepercayaan.

"Apa yang penting berhubung perkara KPN baru untuk polis baru dan saya harap Najib mempertimbangkan secara serius penubuhan IPCMC yang mana tidak hanya melihat kepada laporan Persuruhjaya Dzaiddin terhadap apa yang berlaku emapt tahun lalu berhubung implimentasi laporan berkenaan. Malahan membentuk blueprint untuk polis dalam tahun-tahun akan datang dan bagaimana untuk mengamalkan polisi demokrasi dan mengembangkan peranan polis," katanya.

Ahli Parlimen Kuala Krai Dr Hatta Ramli berkata, resolusi yang dipersetujui dalam persidangan lebih dua jam berkenaan merupakan langkah besar dalam proses lantikan jawatan kanan negara.

Katanya, pengumuman Najib mengenai KPI mengurangkan 20 peratus kadar jenayah jalanan pada penghujung tahun 2010 merupakan satu undi tidak percaya beliau terhadap Musa Hassan.

"Saya rasa sebenarnya adalah satu undi tidak percaya kepada KPN yang ada sekarang, beliau harus faham apabila ia dimasukkan dalam KPI bermakna kerajaan tidak boleh lagi bertoleransi. Cuma mungkin mengikut perdebatan kita tadi, kerajaan serba salah untuk menukar KPN. Jika KPN masih ada sedikit sensitiviti dan maruah maka beliau tidak patut menawarkan diri menyambung khidmat," katanya.

UNISEL: Pemuda Pakatan ulangi desakan ganti Rosmah

Pemuda Pakatan Rakyat Selangor mengulangi desakan kepada kerajaan negeri itu supaya menukar segera Canselor Universiti Industri Selangor (UNISEL), Datin Seri Rosmah Mansor yang didakwanya tidak layak dan kompeten untuk menduduki kerusi berprestij itu.

Dalam satu kenyataan bersama, ia berkata ianya selaras dengan sokongan tidak berbelah bagi mahasiswa dan pensyarah UNISEL sendiri - dalam satu program yang dihadiri Datuk Seri Anwar Ibrahim - yang mahukan Canselor UNISEL ditukar segera.

"Malahan kita yakin masyarakat di Selangor juga mahu kepada seorang Canselor UNISEL yang boleh mencerminkan prestij dan imej keilmuan dan taman budi sebuah gedung ilmu negara," kata kenyataan itu lagi.

Menurutnya, kerajaan negeri sepatutnya sudah menyedari dan bertindak proaktif untuk menukar Canselor UNISEL kepada individu yang lebih berkelayakan dan mempunyai nilai ilmu, akal budi dan akhlak murni yang tinggi.

"Ia adalah salah satu usaha progresif bagi mencerminkan gerak kerja bersungguh-sungguh kerajaan negeri memartabatkan insititusi pengajian tinggi ke peringkat global.

"Kita mahu UNISEL dipandang tinggi dan dihormati di peringkat antarabangsa sebagai sebuah gedung ilmu yang mampu mencapai standard universiti tersohor dan terbilang dunia.

Untuk jadi universiti terbaik


"Justeru, Pemuda Pakatan Rakyat mengulangi desakan agar pertukaran Canselor ini disegerakan kerana jelas penolakan mahasiswa dan pensyarah sendiri yang menyatakan pendirian ini secara terbuka. Kerajaan negeri perlu memilih individu yang paling sesuai dan terbaik untuk Canselor baru UNISEL akan datang," tambah kenyataan itu lagi.

Menurutnya, Pemuda Pakatan Rakyat yakin, apabila kerusi Canselor UNISEL disandang individu yang layak dan mempunyai ilmu dan akhlak yang tinggi, maka usaha ke arah meninggikan dan martabat kedudukan UNISEL akan semakin bersemarak.

"Pemuda Pakatan rakyat bertambah yakin UNISEL kelak akan menjadi salah satu universiti terbaik dunia yang pada kelasnya yang tersendiri.

"Justeru, kerajaan negeri hanya mempunyai satu sahaja pilihan iaitu meletakkan individu terbaik dan paling layak untuk kerusi Canselor UNISEL ini," tambahnya.

Najib 'an iron fist in velvet gloves'

Former health minister Chua Jui Meng, the most senior BN politician to have defected to Pakatan Rakyat, has described Prime Minister Najib Abdul Razak as a leader who conceals his iron fist in a velvet glove.

"Najib is a decent man, I rather like him, he is a great PM, but he cannot be blameless because the PM calls the shots," said Jui Meng.

"The PM in this country is too powerful - (he has) too much power over the institutions and parliament. I think it is time, and I hope that if Anwar (Ibrahim) ever becomes the PM, he will trim down these powers and give them back to the people,", said Chua (left).

A former MCA vice-president and two-time unsuccessful candidate for party president, Jui Meng defected to Anwar's PKR two weeks ago.

Jui Meng, who has the distinction of being the longest serving health minister - nine years in all - talked to Malaysiakini last week at his home in Bukit Damansara.

He said that despite having left MCA, he was still a friend of party president Ong Tee Keat.

"I think he is a man that does what he says, and says what he does, a straightforward man, I like that kind of person," said Chua, a four-term parliamentarian for Bakri in Johor.

But the same cannot be said about Chua Soi Lek, the deputy president who is said to be making clandestine moves to oust Ong.

Jui Meng strongly hinted that Ong is being backed by Umno.

"I said very clear during an address in my division assembly that today there are two MCAs - one elected by the delegates of central committee, and the other by the external forces.

"I see that Soi Lek is using his position to garner support for a future fight, so there are two MCAs, you cannot get away with it. You ask the people on the street, they will tell you that there are two MCAs, not of Tee Keat's making, but one made by an external force."

The following is the first of a two-part interview.

Malaysiakini: On the timing of your crossover to PKR, why did you pick now?

Chua: Very simple. The opposition coalition is under threat, both from conflicts within, but most importantly, threats from outside.

Were you thinking about this (the defection) for long, or was it a sudden decision?

It was a very quick decision.

How quick? Was it within weeks?

It was very fast. It was almost as though I was meant to do that. You know how it works in life - you may think about it, and then you put it at the back of your mind. But I have been thinking - whether I should do this or not - for quite some time.

I love this country, and I have been in politics since May 13, 1969. In my heart, Malaysia is a beautiful country, with rich resources... then I see what is happening here. Why is it that there are still large segments of the Indian community poor, and the poorest states in Malaysia are the Malay states, why are the natives of Sabah and Sarawak suffering from poverty?

Hasn't God created this country with so much wealth so that the people can flourish and prosper together and live as one nation? These are the thoughts that have been going on in my head.

How long have you been thinking about this disparity?


I have been thinking about this even when I was a MCA member from 2005 to 2008, when I was bidding for the MCA presidential election, I had time to think about it.

A combination of events is shifting in this nation. This country is so wealthy. Dr Mahathir aked about the huge revenue to the government from petroleum, where is the money? Why is there so much poverty in Sabah, Sarawak, Kelantan, Terengganu, Perlis, Kedah? It doesn't make sense. Something doesn't gel there.

What was the catalyst?

I don't think you can say that there was any catalyst. A combination of events is shifting this nation.
When did (de facto PKR leader) Anwar Ibrahim talk to you?

Only recently. Approaches have been made to me, not by Anwar, but by others. I was offered a parliamentary seat even before the general election in 2008 and after the 2004 GE. I said to them, 'Sorry, I had an agenda within the BN'.

I was hoping to reform in MCA ... and hopefully there will be some respect for MCA under a new leader of Umno, and MCA can have its own stand on policy matters.

When was your first meeting with Anwar?

[No answer].

Why didn't you join PKR after the 2008 GE, after the MCA lost many seats?

Well, the thing is this, I lost at the national level, but I won at the divisional level after a hard fight. I can't just leave my people and abandon them, and go over to one of the opposition parties, whichever it may be. I can't just abandon them. I'd like to have a good start and a good ending.

Some people interpret that after the recent war of words between you and (MCA deputy president) Chua Soi Lek, you seem to have found a new alliance with (MCA president) Ong Tee Keat.

No, I did not seek a war with Chua Soi Lek. After he got himself in a big mess with the scandal of the (sex) video. I was the only MCA leader that said something to comfort and bless him, expressing my sympathy to his wife, children and family. And I had no reason to do that.

He allied himself against me for several years now. Various things developed, I could see him coming to Bakri, my constituency, when he was the state-level chairman of Johor. I knew he would marginalise me, but there are certain things which you just keep to yourself.

Did Soi Lek see you as a threat?

Perhaps. I wouldn't know why he would do that. In politics, certain things are more obvious than other things. Then he came out with statements, undermining me, in Sin Chew Daily. It was quite a big article in the newspaper, national edition, not Johor edition, saying that I literally sabotaged the Barisan Nasional during the general election.

You cannot impale my honour and get away with it for your own political motives, which is why I have to come up and defend myself. I didn't seek a war, he did, and I just have to clear my name.

You have been a good friend of Tee Keat. But now that you have crossed over to PKR when he is facing internal problems, it does not look very good for him.

Before I leave, I made sure that I made my message very clear. On both occasions, when I was campaigning for the MCA presidential election, I came out - with no governmental and party position, except for my divisional chairmanship - with 36 percent (support) and the last one, 40 percent.

I have some standings in the party, and people recognised that. My reform was a statutory reform - it was not "play, play" reform, but real reform.

So you don't think Tee Keat will be able to bring about reforms?

When I saw Tee Keat being threatened, I told myself 'that is my friend, this is the guy who stood by me', so I must do something to support him. When we fought in the presidential election, we fought on principles - no matter who wins, we remain as friends after the election.

Ong Tee Keat is still my friend, therefore I will stand by him. I think he is a man that does what he says, and says what he does, a straightforward man. I like that kind of person. So I said I will give him support, the central delegates will give him support. I did it not once, but twice.

At the last divisional AGM (annual general meeting), I told the people that this would be the last AGM that I would be addressing after 23 years. I sent very clear signals, my divisional people knew for some time that my heart is not in this local petty politics.

Some MCA sources claim that you are past your prime but you are still ambitious.

That was a fallacy first created by (former MCA president) Ong Ka Ting, (by) linking age to performance. This theory is nonsense, (it) forced all the young people to leave the party. You can be young and feel old, you can be old and feel young.

For me, if you have a passion for something, you are still young. I remember David Yeoh, a former senator, who said that, 'I am 72 today, but I am prepared for a fight, I am prepared for the struggle. And when I joined PKR, I feel 27.' This is because he have passions.
Well, so have I.

Do you think there will be a huge number of MCA members who will follow your footsteps by joining PKR?

I have not asked anybody to do so. I came out, and came out myself, with my principles (intact). I had stated my principles clearly, they know that I had spoke about clear reforms in the MCA during the two presidential elections. They understand my heart. Those who are prepared to identify with my stand, about how I feel that this country should evolve, if they want to come, please come.

When people crossover, they usually evaluate the level of influence a leader has by looking at the number of members following his footsteps.

To me, that is not the most important thing. Just be true to yourself. When you are true to yourself, you are a one-man army.

Are there any indications that members in your former division will follow you?

I don't know about that. But I had signed an agreement with my deputy, who actually fought against me at the divisional election, saying that I will pass it on to him, with the condition that my divisional members can choose to go or stay. He will appoint my secretary as his secretary, treasurer, so on and so forth, which he did. So it was a happy separation from the division. My people are taken care of.

People are saying that you are unable to bring your own people across.

Does it matter? Only time will tell who will follow me. I do have calls. I would not pressure them to do it tomorrow, it is still early. A big group of several hundreds of MCA people from Sungai Besar are coming to support Anwar in a function. You see what is happening in this country, more and more people are saying the two-party system is under threat.

Does that mean you have given up hope on Tee Keat in bringing reforms in MCA?


I am hoping that he would. Although when he fought for the party election ... I can see that he's trying, especially in the PKFZ (Port Klang Free Zone) issue. But in BN, there is only one dominant party, and they call all the shots.

In fact, I told Tee Keat, your presidency is going to be tough, the expectation of the people is very high... the options are very limited. For example, where is the PKFZ report, which he said he was going to distribute it to the members of parliament? MCA didn't call the shots. As the minister of transport, Tee Keat didn't call the shots.

Unless the big boss says you can release, you can't release. I understand that Tee Keat is facing external forces, I told him to expect that.

I see that Soi Lek is using his position to garner support for a future fight, so there are two MCAs, you cannot get away with it. You ask the people on the street, they will tell you that there are two MCAs, not of Tee Keat's making, but one made by an external force.

That external force seems to be Umno. In your speech the other day, when you were announcing that you are joining PKR, you had made it very clear that Umno was undermining the two-party system.

Obviously.

How do they do that?

Very obvious. MACC (Malaysian Anti-Corruption Commission) goes into Perak, suddenly very hardworking, extremely competent, and arrested two of the Keadilan YBs - and the two are very critical - and charged them for corruption. This shows how they are systematically using the institutions of this country. Perak has been a big blow for democracy. I was one of he MCA leaders who said back in the early days that we should call for an election in Perak.

Then we have so many other issues one by one, all the government agencies created by the constitution ... the police and MACC are meant to protect the interest of the people ... but they have been used.

I mean, it was so obvious, when you want to do something, do it cleverly, but they did not even try to hide it, they do not care anymore. People are upset, that is the most stupid thing any government can do. The people will say, enough is enough, time is up for you, we are the ones deciding what will happen to this country in future, not the government.

In many ways, Najib has been told to change, if not the people will change the government. The March 2008 general election is a demonstration of change wanted by the people. For the first time in a long time, people from all races want change together.

The MACC was expected to be a better version of the ACA (Anti-Corruption Agency). Former premier Abdullah Ahmad Badawi sought to create MACC as an independent agency.

I am sure Abdullah meant well when he created this organisation - to make sure that the interests of the people are protected, but the operators of the organisation had let themselves and the people down.

So is Najib worse than Abdullah in using government machineries?


Unlike Abdullah, we now have an iron fist behind the velvet glove. Najib is a decent man, I rather like him, he is a great PM, but he cannot be blameless because the PM calls the shots. To say that he does not have a substantial influence, I would not be telling the truth.

The PM in this country is too powerful - (he has) too much power over the institutions and parliament. I think it is time, and I hope that if Anwar ever becomes the PM, he will trim down these powers and give them back to the people.

Do you think Anwar will be able to do that?

I hope he can do it. I had address this to him when I join PKR. 'There were some people who don't think highly of you in the past. You must really implement the Malaysia agenda and manifesto', he replied: "Chua, I went through six humiliating years in prison. I think one must go through the ... experience in order for you to have a character change."

So what kind of role will you play in PKR?

I have a great sense of freedom, all the shackles of the past - the MCA monoracial culture - have been broken off me. It was an amazing sense of freedom. MCA - Chinese, Chinese, Chinese, we must have more Chinese people like in China, Chinese language must be our first and formal language, that kind of thing.

And now I have come to a multiracial party, I said: "Look! I love the Malays of this nation, I took good care of the Malays when I was the minister of health, I would like to do something for the Malaysians, I do not want to see poor Indians, Malays, and Chinese.

So you felt shackled by MCA because of their approach and their racial politics?


I am only using the word "shackle" to express how free I feel, but it doesn't mean that I was shackled during the 23 years in MCA, but I felt restrained.

I love the multiracial approach, I see in PKR a unique opportunity to change this nation and the way the government has been working.

Police probe 'more or less' done, ready for inquest

The police have 'more or less' completed its investigation into the death of political aide Teoh Beng Hock, said Selangor police chief Khalid Abu Bakar today.

He said the police are also ready to face the inquest, which starts tomorrow.

Speaking at a press conference at the Selangor police headquarters in Shah Alam today, Khalid said the investigating team is waiting for a few more expert reports, such as from the pathologist.

He added that they expect to receive the reports later this evening.

Khalid also revealed that the police have recorded statements from 77 people, including 28 officers from the Malaysian Anti-Corruption Commission (MACC).

All of them have been subpoenaed to take the stand at tomorrow's inquest, he added.

Stating that the police still classifies the case as 'sudden death', Khalid however refused to reveal the outcome of the investigations on the grounds that an inquest will be held.

Asked if the police anticipate a protest at the inquest by those who feel that the government is not doing enough, Khalid said: “This is a process of justice, it would be stupid to have a protest.”

Teoh is said to have plunged to his death from the 14th-floor of the Selangor MACC office in Plaza Masalam, Shah Alam, on July 16.

Former ACA official: Teoh held unlawfully

EXCLUSIVE Standard procedures “were not followed” on July 15 by the Selangor Malaysian Anti-Corruption Commission (MACC), when it questioned DAP political aide Teoh Beng Hock at its office in Shah Alam.

Pointing this out when asked by Malaysiakini, a senior officer who retired from the Anti-Corruption Agency (ACA) in 2006, further alluded to malice on the part of the MACCin having exceeded its powers.

Mohamad Ramli Manan (left), in an email interview, said Teoh's interrogation was carried out beyond office hours and that this could be considered as “unlawful detention”.

The MACC had called in Teoh as part of its investigations into the alleged misuse of constituency development funds by several Selangor Pakatan Rakyat assemblypersons, including his boss and exco member Ean Yong Hian Wah

“It is against established law and practice to interrogate them (suspects) in the night. The lock-up rules demand that they be sent to a lock-up by at least 8pm,” Ramli said.

“Witnesses are sent back to their offices or homes and asked to be present at another appointed date. I don't know why they had to call Teoh at 5pm. This may be due to poor planning or some evil intention or evil purpose on their part.”

Teoh was reportedly released by the MACC at 3.45am on July 16, but his body was found on the fifth floor balcony of Plaza Masalam about 1.30pm. The MACC occupies the 14th floor of the tower block overlooking the plaza.

During his service with the ACA, Ramli was deputy head in Kedah, Perak and Negri Sembilan, before being appointed to head the agency in Kelantan, Malacca, Johor and Sabah.

He shocked the nation in early 2007 when he alleged that then ACA director-general Zulkipli Mat Noor was involved in corruption and a sex offence.

Zulkipli was later cleared by the attorney-general's chambers, but his contract was not extended when it expired in March 2007.

Witness' consent required


Although the MACC was upgraded from the ACA early this year, Ramli said the investigation and interrogation procedures remain the same.

Under the ACA, interrogation used to begin as early as 8am and end between 7pm and 8pm.

“The rights of a witness are protected more than that of a suspect, who is under detention...the person can demand that the interview be adjourned to the next morning.

“The examining officer has to oblige, failing which this becomes an (unlawful) detention or arrest.”

He said the examining officer must also get the witness' consent to continue the interrogation beyond 8pm.

“Normally witnesses would consent to staying a bit longer until 9-10pm to have their statement recorded. But if they don't consent, there is nothing that the examining officer can do but to request that the interview be continued the next day. This is the law.”

Ramli cited media reports that Ean Yong (left) had turned up at the Selangor MACC, asking that Teoh be released. However, MACC officials claimed that they had 24 hours to question him.

“This shows that Teoh was definitely in the custody of the MACC. Under Section 15 of the Criminal Procedure Code, an arrest occurs when you confine the person (physically). Thus there was unlawful detention or arrest of Teoh.

“If there had been no detention, they should have allowed Teoh to go home at around 9pm or 10pm and requested him to come back the next day. He was definitely held against his will.”

After Teoh's death, the MACC said Teoh was merely a witness in the investigation, but did not state that he had been arrested or detained. It also claimed that Teoh wanted to rest for a while at the office after he had been allowed to go.

Preliminary police investigations have, however, found out that Teoh's mobile phone was still with the MACC at the time of his death.

Ramli said MACC should have issued an acknowledgment to Teoh upon his release, listing all the items they had taken from him.

“If no (such) list had been given to Teoh, it is difficult to say that he had been allowed to leave the office,” noted Ramli.

MACC has not confirmed if an acknowledgment list was given to Teoh.An inquest to probe the circumstances surrounding Teoh's death is due to start tomorrow, and will continue to Aug 12.

Taktikal Anwar Ibrahim Jauh Di Depan

Jelas terdapat dua pendekatan berbeza yang digunakan oleh dua jentera yang bersaing untuk menyambar pucuk pimpinan Malaysia. Cara yang digunkan oleh Paktan Rakyat ialah membujuk rakyat supaya menerima idealisme perjuangannya dan bersama sama dengannya dalam usaha menjatuhkan Barisan Nasional.

Cara ini adalah cara yang digunapakai disemua demokrasi didunia ini, iaitu rakyat memilih pimpinan mereka tanpa sebarang tekanan atau ugutan. Dalam hal ini, kelihatan Anwar Ibrahim berada jauh di hadapan dengan membujuk beberapa figur besar barisan nasional untuk menyertai PKR dan dengan itu berada dalam saf PR. Nama nama seperti Zaid IBrahim, Chua Ju Meng, S. Subramaniam adalah stok terbaru yang masuk dalam persenjataan PR.

Ini adalah satu cabaran yang sangat sukar ditangkis oleh BN. Sebabnya ialah figur yang keluar BN dan masuk PR ini bukan keluar bersaorang, tetapi membawa penyokong mereka bersama. lebih menggerunkan lagi ialah figur figur ini juga menghayunkan pengundi kepada PR. Kalau 1000 orang sahaja yang mengikut S. Subramaniam melompat ke PKR itu tidak begitu memitamkan, tetapi angka ini akan menjadi berlipat ganda semasa pilihanraya, kerana setiap 1000 ini pula akan ada pengikut masing masing, dan setiap masing masing itu pula akan berkempen menghayunkan pengundi jauh daripada BN.

Parti Gerakan sudah tidak bergerak lagi. Ia sedang koma sekarang. MCA sedang nazak. MIC sedang mengalami pembedahan major. Parti parti BN yang nyamuk sedang dikecai kecai oleh tangan tangan sendiri. UMNO sukar bernafas.

Oleh itu BN, demi survival , menggunakan cara yang mereka warisi daripada penjajah. The end justifies the mean. Cara yang ada pada mereka hanyalah dengan memafiakan tindakan dengan memperkudakan instrumen negara. Posting ini tidak mendetailkan segala tindakan kemafiaan tersebut, tetapi kau tau kan?

Pengkhianatan Kaum Bangsawan

Bahasa Melayu bukan bahasa kelas bangsawan. Mereka akan sentiasa mencari sesuatu yang eksklusif, bukan inklusif; mencari ciri yang istimewa untuk diri mereka, dengan meninggalkan ciri yang ramai.

Hanya dengan itu, maka mereka kekal sebagai kelas bangsawan.

Saya merumuskan begitu. Sebabnya? Sebab kelas bangsawan tidak akan pernah berani bersaing di gelanggang terbuka. Demikian mereka merebut segala bentuk “dasar perlindungan”, untuk melindungi diri mereka. Bukan untuk melindungi rakyat jelata. Dan rakyat, selamanya akan kepanasan.

Kata WS Rendra dalam sebuah sajaknya yang utama, “Sajak Orang Kepanasan” yang tidak lain dihalakan kepada kelas berkenaan:

Dan kamu gemerlapan
Karena kami sumpeg
Dan kamu mengunci pintu
Maka kami mencurigaimu

Apa itu yang saya maksudkan sebagai “dasar perlindungan.” Ada. Misalnya, Dasar Ekonomi Baru (DEB), adalah dasar perlindungan. Lihat sahaja bagaimana para pembesar dan anak-anak mereka, dan menantu mereka beriya-iya melalak dan mahu DEB dipertahan.

Bukan untuk rakyat, sementara mereka tahu, keuntungan yang jauh lebih besar adalah untuk diri mereka sendiri–kalau boleh, mereka mahu meletakkan diri di atas segala undang-undang. Kalau boleh di atas Perlembagaan sekalipun.

Bangsawan, secara fitnah dan resamnya, tidak pernah, dan tidak akan berani. Ketidakberanian mereka itu, adalah karena kebangsawanan mereka itu, mereka warisi. Bukan dari kebijaksanaan mereka sendiri.

Sabtu sudah, saya berkesempatan berceramah dengan Sastewaran Negara, A Samad Said. Di kampung saya. Di Semerah, Johor.

Antara yang dikupas Pak Samad adalah, saya rumuskan, seperti yang saya rumuskan di atas– Bahasa Melayu adalah bukan bahasa golongan bangsawan feudal… kaum yang memiliki kekayaan, dan kedudukan tinggi di dalam pemerintahan, adalah karena ‘mewarisi’.

Perdana Menteri ke-6, sekarang, antara contoh jelas. Dia tidak akan melakukan kerja lain, selain sebagai orang politik, sepertimana bapanya, Tun Razak Hussein. Lihat sahaja bagaimana anak bekas PM-4, juga sedang meniti tangga politik dan mati-matian mempertahan dasar PPSMI yang diperkenal dan ‘diperturunkan’ oleh bapanya, Tun Dr Mahathir.

Ketua Pemuda Umno, anak seorang bekas duta; menantu PM ke-5… juga bangsawan yang punya nafsu politik bukan kepalang.

Kata Rendra lagi, dalam sajak yang sama:

Dan kamu memaksakan kekuasaan
Maka kami bilang TIDAK kepadamu

Apakah mereka peduli dengan “harga diri” dan maruah Bahasa Melayu? Tidak-tidak-tidak!

Seandainya orang Melayu seluruhnya bertutur di dalam bahasa Inggeris, ‘cair’ dan lancar, percayalah, kaum bangsawan ini akan mencari jalan untuk bertutur di dalam bahasa lain, selain daripada bahasa Inggeris. Mungkin waktu itu mereka akan bertutur di dalam bahasa Perancis, atau Jepun, atau Arab… tak mustahil di dalam bahasa Jawa kalau bahasa Jawa dilihat sebagai bahasa yang boleh menunjukkan mereka adalah kelas tersendiri: kelas bangsawan.

Saya agak terkejut apabila Pak Samad membawakan kenyataan kelas sebagai antara hujah mengapa bahasa Melayu dikhianati, bukan oleh orang asing, tetapi oleh pemimpin Melayu itu sendiri. Kenyataan ini adalah kenyataan besar, yang selain lama cuba disembunyikan.

Bangsawan Melayu itu, tidak lain adalah bangsawan feudal. Bangsawan lapuk. Bukan satu kelompok manusia yang gigih dengan perjuangan untuk hidup. Yang akhirnya berjaya. Bangsawan Melayu itu (juga bangsawan Cina dan India, yang lahir daripada kurniaan DEB) tidak pernah ada ketrampilan cediakawan di dalam diri mereka.

Perhatikan sahaja rumah mereka, yang barangkali berjuta, atau puluh juta ringgit, tidak ada perpustakaan walaupun sekecil tandas. Buku adalah perkara yang terakhir yang mereka fikirkan. Atau tidak fikirkan langsung.

Yang pertama bermain di dalam kepala mereka, adalah pakaian. Sudah tentu dengan jenama yang tiada tara. Jam tangan, kasut, kereta. Kemudian baru sukan atau gaya hidup yang perlu meyakinkan diri mereka sendiri bahawa mereka adalah bangsawan.

Rakyat bukan mereka. Mereka bukan sebahagian daripada rakyat. Rakyat bagi mereka boleh dibeli. Boleh diumpan. Boleh diikat hidungnya. Terutama dengan janji-janji pembangunan, dan wang ringgit.

Betapa jeleknya golongan bangsawan ini, seperti yang pernah saya saksikan sendiri, bagaimana misalnya anak-anak mereka pun dilarang untuk berkahwin dengan anak orang kebanyakan. Tidak boleh! Haram! Walaupun pencapaian anak orang bawahan itu, sesungguhnya jauh lebih baik daripada apa yang dicapai oleh anak-anak golongan bangsawan.

Kembali kepada mauduk dan persoalan bahasa, kaum elit dan bangsawan ini, tidak pernah peduli dengan bahasa Melayu… yang sekonyong-konyong mereka anggap sebagai “bahasa kampungan.” Betapa butanya mereka bahawa semua bahasa ada bahasa pasarnya sendiri, dan ada juga bahasa kelas tingginya sendiri.

Pengkhianatan terhadap bahasa ibuanda kita, bahasa Melayu, jelas nyata dilakukan oleh elit-bangsawan ini. Dan merekalah yang harus kita sasarkan serangan.

Sementara kita tahu besar, mereka akan mendirikan tembok dan perisai di kalangan rakyat biasa… yang belum punya kesedaran untuk membebaskan diri daripada janji manis, daripada umpan wang ringgit yang tak seberapa, dan daripada sistem feudal yang dipaksakan agar rakyat percaya dengan penuh yakin.

Karena kami arus air kali
Dan kamu batu tanpa hati
Maka air akan mengikis batu
.

Penentangan terhadap kelompok kecil ini, adalah penentangan terhadap feudalisme itu sendiri. Bukankah itu antara maknanya reformasi?

Berfikir Secara Positif

Fikiran manusia mempunyai dua dimensi iaitu ; bisa mengajar anda membuat baik dan beramal soleh atau membuat jahat dan beramal maksiat. Manusia bisa berfikir secara kehambaan dan ke – Tuhan-an mengesakan ‘Dia’ yang empunya global , atau berfikir secara ke – Berhala-an dalam diri kerna tidak kenal diri dan yang empunya diri ; justeru kerna nafsu yang tersembunyi dalam diri ; dengan keterampilan karektor ego, sombong dan bongkak . Yakni, syirik kahfi mengkahfi atau halus lagi menghalusi dan tersembunyi di dalam diri kerna ada berhala dalam diri kendiri.

Fikiran itu adalah doa yang datang dari hati . Justeru itu, apa yang tertasdik di dalam hati, berbuah di dalam fikiran dan ditempa di dalam perbuatan adalah doa belaka dan perlakuan serta perkataan doa diri itu sendiri.

Anda haruslah berfikiran positif supaya yang positif bisa berlaku kerna zat , sifat, asma’ dan af’al anda adalah menjurus kepada ‘Dia’ dengan berbaik sangka dengan ‘Dia’. Dalam ke-Tuhan-an jika anda tiada yakin kepada diri anda sendiri, sebenarnya anda sudah menolak ‘Dia’. Justeru kerna, anda datang dari ‘Dia’ hidup kerna ‘Dia’, dengan ‘Dia’(‘of HIM not HIM’ )dan akan kembali kepada ‘Dia’ dan tiada yang lain melainkan ‘Dia’.

Artinya , menolak diri kerna tiada keyakinan diri sama dengan menolak yang empunya diri, yang empunya nyawa , yang empunya rezeki, pangkat, kuasa dan kedudukan. Bila mana diri itu datang dari ‘Dia’ dan pastinya akan kembali kepada ‘ Dia’ Maka fikiran yang positif akan ‘Dia’ adalah muktamad dan pasti . Justeru kerna, ‘Dia’ tiada bisa zalimi hamba-hambanya kerna manusia yang bisa menzalimi dirinya sendiri.

Jika anda berjanji dengan seseorang dan memungkiri janji anda dengan mengemukakan pelbagai alasan . Rakan anda mungkin memaafkan anda. Tetapi , apakah ‘Dia’ bisa memaafkan anda . Dosa anda tidak bisa tertebus melainkan anda dengan penuh kesedaran diri dan keinsafan diri menyatakan pada diri anda sendiri : “ Laila hailla anta, subhanakaini kuntuminadzolimin” ( Tiada tuhan melainkan ‘;Dia’ dan sesungguh aku telah menzalimi diri aku sendiri; yakni , memohon ampun ke atas diri sendiri yang datang dari “ Dia’ lantaran membersihkan diri secara fitrahnya nan asli ) Maksud Qur’an.

Oleh kerna, percakapan itu adalah doa. Maka berbicaralah yang baik-baik sahaja dan janganlah berdoa yang buruk berlaku kerna percakapan yang buruk jika disebut berkali-kali akan menjadi realiti kecuali yang baik yang keluar dari mulut anda ; insyaAllahu yang baiklah yang akan berlaku. Jangan salahkan ‘Dia’ kerna anda yang meminta samada anda menyedari atau tidak menyedarinya.

Sebagai anologi, anda yang berbadan sihat dengan sengaja menyatakan kepada diri anda sendiri “ aku sakit” sebanyak 100 kali atau 1000 kali. Apakah anda tidak bisa jatuh sakit! Ini satu bukti cakap itu adalah doa . Sebaliknya, jika anda rasa ‘kurang sihat’ tetapi yakin diri dan menyatakan ‘aku sihat’ kerna tiada apa kuasa yang bisa menyihatkan aku , kecuali “ Dia” inyaAllahu “ Dia” bisa menyihatkan anda di samping mengambil obot secara ikhtiar fisikal kerna obat pun “Dia” yang punya. Tetapi, yang menyembuhkan bukan itu obat , tetapi yang empunya obat ! . Dengan berfikiran positif sebegini anda senantiasa di dalam keadaan tauhid atau mengesakan ‘Dia’ sepanjang masa. Yakni, tiada syirik kepada ‘ Dia’

Anda juga tiada seharusnya merungut akan apa yang berlaku di depan mata kepala anda , kerna jika anda berbuat demikian anda sebenarnya mempersoalkan dan mempertikaikan sesuatu yang sudahpun ditetapkan ‘Dia’ sejak azali lagi.( ‘Loh Kun’ ) Sebagai contoh, anda sedang memandu mobil . Tiba-tiba muncul seekor lembu di depan anda. Jika anda memaki-hamun lembu itu , bukanlah bererti anda memaki ‘Dia’ kerna lembu itu tiada berfikiran dan tidak tahu apa-apaan.” Dia’lah yang sebenarnya yang meletakkan lembu itu di situ ! . Mengapakah harus lembu itu di maki . Bukankah anda sebenarnya memaki ‘ Dia’. bukannya lembu itu , bukan!

Bukankah lebih bagus anda mendiamkan diri sahaja. Diam dalam percakapan, diam dalam perbuatan dan diam dalam diam ; brek sahaja secara automatis dan tunggu sahaja, saksikan sahaja lembu itu beredar . Pastinya tauhid anda tidak bisa rosak atau terbatal insyaAllahu . Jika tercelupar, segeralah meminta ampun ke atas diri anda di atas kesilapan yang anda lakukan itu. Justeru kerana, jika anda tiada minta ampun ; di khuatiri putus rahmat anda dengan ‘Dia’; kerana pada hakikatnya anda telah mengata ‘Dia’ .samada di sedari atau tidak disedari; di sengajai atau tidak disengajai.

Perlu ada hubungan tauhid atau ke-Tuhan-an sepanjang masa dalam ‘Se’. Jika anda memandu, ‘Dia’ lah pemandunya kerna yang menjamin pemanduan adalah ‘ Dia’ . Maka pintalah keselamatan daripada ‘Dia’; kerna ‘Dia’ tidak bisa memberi jika anda tidak bisa meminta.

Oleh yang demikian, janganlah kamu sekali-kali melakukan kezaliman sesama manusia kerna dikhuatiri jika ramai yang menyumpah di atas perbuatan kamu itu; di dalam satu gelombang atau frekuensi yang sama . Kemungkinan sumpahan itu berlaku adalah tiada mustahil kerna cakap itu adalah doa. Apalagi , ‘Dia’ bisa mendengarinya kerna doa orang yang dizalimi tidak bisa ada hijab dengan ‘ Dia’ sekalipun cakap-cakap itu datang daripada orang bukan Islam. Dalam 44 orang yang memohon, mungkin doa seorang di kalangan yang ramai itu dimakbul ‘ Dia’ insyaAllahu .

Jika anda sedang menyaksikan gerombolan mat rempit yang beraksi ngeri. Tiba-tiba tertasdik di dalam hati anda berkata, “ budak-budak ini nak kena langgar ni” . Bagaimana jika mulut anda itu masin ketika itu , tiada mustahil kemalangan akan berlaku ke atas mereka. Bukankah lebih baik hati itu bicara yang positif , umpamanya; “berhentilah berlumba dan buatlah kerja-kerja yang mendatangkan faedah”. Mungkin budak-budak rempit itu bisa berubah.

Yang paling menakutkan sekali adalah doa ibu. Seandainya si ibu sangat memarahi anaknya kerna perbuatan atau kesilapan anaknya yang menyakitkan hati itu. Lantaran memaki-hamun dan menyumpah anaknya itu. Tanpa disedari dia telah mendoakan keburukan dan menempah bala datang menimpa anaknya . Justeru kerna, cakap itu doa! .Bercakaplah hal-hal yang positif lebih-lebih lagi terhadap anak sendiri kerna doa atau cakap-cakap ibu itu lebih makbul sifatnya. “ Dia” sebenarnya melakukan apa yang ada dalam fikiran anda. ( “ If a man thinks, so does HE thinks) Maksud Qur’an :” Kami tidak akan mengubah nasib sesuatu kaum itu , kecuali kaum itu sendiri yang berusaha untuk mengubahnya “; ternyatalah ‘Dia’ tidak bisa zalim .

Justeru itu, bertindaklah secara positif dalam ingatan, fikiran, rasa, perasaan, gerak, perbuatan dan percakapan mentauhidkan ‘Dia’ dan tiada membatalkan ketauhidan anda dalam ke-Tuhan-an mengesakan “ Dia’ senantiasa dalam ‘Se’ dalam zat, sifat, asma’ dan af’al . InsyaAllahu bisa mendapat barokah daripada ‘Dia’ dan hidup anda itu berkat, beriman, bijaksini dan bijaksana
