BELIEVE IT OR NOT...!!! Jeng..Jeng....????

Come Wednesday the Inquest on the circumstances surrounding the death of Teoh Beng Hock will be conducted by the Magistrate court. I thought that excerpts from Dr Raficks Part 1 to Part 7 postings would kind of prepare us for what to expect.

Before he embarked on these postings he wrote on 18 July 09:

The death is a bad omen for the country. It is a bad sign internationally. In the mind of the people, the action of the police and MACC has always been slanted. The death of a politician while he is in the compound of MACC raises a lot of questions. No one that I talk to believes that it is an accident. Speculation is rife that it is murder or an accident while being interrogated. There is a strong rumor that he died in the hands MACC while being interrogated and his body was thrown out the window to cover up the death. The government can say it views the incident seriously and looking at setting up a royal commission but how many people really trust the present government?

In reality with the current BN government is perceive as muscling the opposition using the country enforcement agencies. The movement of the Malaysian Non BN political parties has always been monitored. I would not be surprised that there is a dedicated task force that is monitoring the movement, actions and decisions made by the PR MPs, ADUN’s and State Exco’s

The way the Police and the MACC conduct its business in this country has not given the people the confidence that they are truly independent. The truth is far less importance then the perception in the eyes of the public. Right now the image of the MACC and the RMP is in a bottomless pit. This will have a big impact on BN

MACC death tragedy – My untrained CSI techniques

The following writing is done based on assessment of various images and writings on the mainstream media (MSM) as well as the online media. I am trying to understand the tragedy that took place at Plaza Masalam. It would be great if I have access to MACC office and location where the body was found but without such access, readers can expect some gross margin of error in my writing. Do let me know what the errors are so that we can come to a clear conclusion on what transpired.


Part 1

The second item of concern is that his body posture is lying on his right side. Why not face down? A man that is conscious at the time of his fall is most likely to fall on his face flat down or his back if he is being pushed through a window. If he had jumped I would expect that he would have ended leg first. The pictures are not conclusive enough to indicate any lower limb fractures. Post mortem would be able to shed some light.


Part 2

I believe that he had died prior of hitting the slab roof the 5th floor podium based on the limited amount of blood on the roof. If his was alive and his heart was pumping, then there would be a large amount of blood on the roof if he did not die instantly.




Part 3

I tried to piece the time Tan met TBH and according to my source, when Tan left a short while later the sun was brightly coming up. He had estimated the time based the sun. I checked the time for sunrise in Shah Alam for the last few days. The sun is up at about 549am.

Assuming that by the time Tan came out from the building, it was about 549-555 a.m., I estimate that Tan saw TBH at about 530am. This means that TBH was indeed alive at 530am. This is about 8 hours before he was found dead.


Part 4

If he had been alive upon exiting the window and died upon impact, I expect to see more blood on the roof. The blood would take about 15 to 30 minutes to clot properly and hence in that amount of time, the blood would ooze through any open wound profusely. This is very true especially there is an arterial bleed.


Part 5

In my previous article, I theorized that either one or two person carried the late TBH whom had died for about 30 mins to the window. He carried the person with TBH on his right side and places it on the windows edge. As he pushed the body out the window, the latch got hooked to the pants at the centre of the trousers. TBH weight and the action of trying to push the body down literally tore the pants towards the left pocket.


Part 6

I wrote because my conscience tells me that what had happen is wrong. Today it happened to TBH. Tomorrow it can happen to us, our siblings and our kids. It is my religious duty (Fardu Kifayah) to share and to find conclusion to this dark episode.




Part 7

Last night I received an email from an anonymous (Lets call him Mr. A) person who claims to be working with the mainstream media. I am not sure whether it is true or not but he claims that all MSM media will be running stories in the next few days that the wound on TBH base left hand (the media will say wrist) will be played up as a sign of suicide. It dawn upon me that I have not said anything about the triangular mark on the right hand.


I was alerted by some readers on the existence of a new blog which has made serious allegations against 2 DAP State Exco members on purportedly explaining “DAP corruption modus operandi” in Selangor at www.t4tbh.blogspot.com. I suspect that it is part of a counter strategy that is being deployed by certain people to deflect the current issue surrounding TBH. Who are they? I can safely assume that what you ever think is right.

Pertemuan serius dengan PAS dibincang MT Umno Jumaat...!!!! Adakah satu lagi sandiwara UG mainan UMNO@BN untuk perangkap PAS...????

Langkah awal yang akan diambil untuk mengadakan pertemuan serius dengan pemimpin PAS ke arah merapatkan hubungan keduadua parti itu akan dibincangkan pada mesyuarat Majlis Tertinggi Umno pada Jumaat ini.

Timbalan Presiden Umno, Tan Sri Muhyiddin Yassin yang menyambut baik kesediaan Menteri Besar Kelantan, Datuk Nik Abdul Aziz Nik Mat untuk berbaik-baik dan melupakan sengketa politik kerajaan negeri PAS itu dengan kerajaan pusat berkata, senario itu akan membuka satu lembaran baru dalam hubungan antara kerajaan pusat dengan kerajaan negeri Kelantan dan parti PAS.

"Saya bersyukur kerana ini adalah satu kenyataan yang positif daripada Nik Aziz yang menunjukkan satu sikap Muslim yang baik.

"Oleh kerana ada keputusan seperti itu, langkah-langkah susulan kita boleh ambil dan terbaik dalam mesyuarat Majlis Tertinggi Umno pada penghujung bulan ini iaitu 31 Julai," kata Timbalan Perdana Menteri kepada pemberita Malaysia di sini hari ini.

Muhyiddin berkata demikian ketika diminta mengulas kesediaan Nik Abdul Aziz yang juga Mursyidul Am PAS untuk berbaik-baik dan melupakan sengketa politik kerajaan negeri PAS dengan kerajaan pusat demi menjaga kepentingan rakyat dan perpaduan Islam.

Nik Abdul Aziz berharap perselisihan pendapat yang timbul di kalangan pemimpin politik terutama antara Umno dan PAS sewaktu kempen pilihan raya kecil Dewan Undangan Negeri Manik Urai, baru-baru ini, dilupakan dan kedua-dua pihak kembali semula kepada semangat persaudaraan sesama Islam.

REAKSI POSITIF

Muhyiddin berkata: "Kita telah menyuarakan sejak awal dulu bila mana soal kerajaan perpaduan dibincangkan, walaupun kita tidak jelas kita telah memberi reaksi yang positif dan kita telah menyatakan kita sedia berbincang demi perpaduan negara dan umat Islam." "Kalau pun ada perbezaan atau salah faham itu adalah adat manusia," katanya.

Beliau berkata, mesyuarat MT Umno itu juga mungkin akan menentukan wakil parti itu untuk berbincang dengan pemimpin PAS.

"Kita tidak perlulah meletakkan agenda khusus dalam pertemuan awal itu yang akan membuka langkah permulaan apaapa perkara yang kita boleh bincang secara bersama," katanya.

Ditanya sama ada Umno akan menghantar barisan pemimpin kanan untuk mengadakan pertemuan dengan pemimpin PAS itu nanti, Muhyiddin berkata, pemimpin yang akan mewakili Umno akan dipilih oleh presiden parti.

"Kita berharap pertemuan itu akan menghasilkan sesuatu yang positif yang bukan sahaja membawa kebaikan kepada kaum Muslim tetapi juga rakyat keseluruhannya," katanya.

IKTIBAR

Mengenai tindakan bekas Naib Presiden MIC, Datuk S.S. Subramaniam yang keluar parti dan menyertai Parti Keadilan Rakyat (PKR), Muhyiddin berkata, perkara itu perlu dilihat sebagai iktibar kepada semua pemimpin komponen parti Barisan Nasional (BN) termasuk MIC.

"Kita harus meneliti di sebalik apa-apa penghijrahan tertentu kepada pihak PKR, sama ada ia sesuatu yang memberi kesan kepada kita (BN) dalam jangka masa sederhana dan jangka panjang.

"Apa pun yang berlaku, pimpinan MIC harus memberi perhatian," katanya.

Muhyiddin juga menyeru pimpinan parti komponen BN supaya terus bekerja kuat untuk mengukuhkan parti demi kebaikan bersama.

"Apa yang penting ialah BN kembali menjadi parti yang kuat dan dilihat sebagai parti yang bersatu padu," katanya. BERNAMA

Mahu mahu kenyataan Nik Aziz dianggap suara parti, bukan individu

PETALING JAYA: Ketua Penerangan Umno, Ahmad Maslan menyambut baik kesediaan Mursyidul Am PAS, Datuk Nik Abdul Aziz Nik Mat yang mahu melupakan sengketa dengan Umno sambil menegaskan "Umno tidak pernah menutup pintu perbincangan dengan PAS."

"Kita menyambut baik apa yang dikatakan oleh Nik Aziz kerana selama ini halangan untuk PAS bincang dengan Umno adalah Nik Aziz.. jadi apabila beliau (Nik Aziz) telah menghulurkan salam, maka kita kena sambut baik dan pintu rundingan sentiasa terbuka.

"Saya yakin Presiden dan Timbalan Presiden Umno masih lagi membuka minda untuk kita duduk berbincang mengenai perpaduan cuma bentuknya itu kita tidak tahu kerana ia melibatkan pimpinan tertinggi.

"Tidak pernah dalam sejarah perpaduan itu merugikan dan tidak pernah dalam sejarah perpecahan itu menguntungkan," kata beliau selepas merasmikan Persidangan Pemuda Umno Bahagian Selayang di Selayang hari ini.

Semalam, Nik Aziz yang juga Menteri Besar Kelantan berkata beliau bersedia menghulurkan tangan untuk berbaik-baik dan melupakan sengketa politik kerajaan negeri di bawah PAS dengan kerajaan pusat dalam usaha menjaga kepentingan rakyat dan perpaduan Islam.


Muhyiddin: Pertemuan serius dengan PAS dibincang MT Umno Jumaat

Pada majlis, Ahmad turut mengumumkan Program Inisiatif Tawan Selangor (PINTAS) untuk menawan kembali Selangor yang jatuh ke tangan pembangkang pada pilihan raya umum ke-12.

Menurutnya, langkah tersebut perlu dimulakan dari sekarang kerana Selangor merupakan sebuah negeri penting dan memiliki sumber kekayaan yang banyak berbanding negeri-negeri lain.

KOMEN BENDAHARI UMNO

Dalam pada itu, Bendahari Umno, Datuk Ahmad Husni Hanadzlah mahu kenyataan Nik Aziz itu dianggap sebagai suara parti, bukan individu.

Menteri Kewangan kedua itu berkata, sebelum ini Nik Aziz secara terang-terangan menolak cadangan penubuhan kerajaan perpaduan yang dicetuskan Presiden PAS, Datuk Seri Abdul Hadi Awang di muktamar parti itu baru-baru ini.

Nik Aziz juga, katanya, sebelum ini memberikan kritikan pedas terhadap Timbalan Presiden PAS, Nasharudin Mat Isa, berikutan sokongannya terhadap idea kerajaan perpaduan.

Enggan pisang berbuah dua kali, Husni berkata, kenyataan itu seharusnya dinyatakan sebagai pendirian dan keputusan daripada parti bagi mengelak ia disalahgunakan untuk kepentingan politik dan individu semata-mata. "Bila betul dia (Nik Aziz) kata nak bersama Umno demi perpaduan ummah, dia kena bagi pendirian sebagai parti", kata beliau dipetik oleh Bernama selepas merasmikan Persidangan Perwakilan Wanita Umno Bahagian Kepong di Pusat Dagangan Dunia Putra.

Sementara itu, Ketua Pergerakan Wanita Umno, Senator Datuk Seri Shahrizat Abdul Jalil meminta Nik Aziz supaya tidak memutarbelitkan kenyataannya itu bagi mengelak timbulnya kekeliruan di kalangan anggota PAS.

Justeru, Menteri Pembangunan Wanita, Keluarga dan Masyarakat itu meminta Nik Aziz supaya tidak mengubah pendiriannya, meskipun mendapat desakan daripada mana-mana pihak.

KUALA LUMPUR 26 Julai - Jentera penerangan UMNO Selangor diminta supaya mengadakan kempen penerangan sekurang-kurangnya sekali dalam sebulan di setiap 56 kawasan Dewan Undangan Negeri (DUN) negeri itu bermula Ogos depan.

Ketua Penerangannya, Ahmad Maslan berkata, program itu merupakan sebahagian daripada intipati Program Inisiatif Tawan Selangor (Pintas) yang dilancarkan secara rasmi hari ini dan menjadi satu daripada usaha penerangan untuk merampas kembali Selangor daripada kerajaan Pakatan Rakyat (PR).

“Melalui Pintas, semua jentera penerangan di setiap DUN diminta mengadakan aktiviti penerangan bagi menarik kembali sokongan rakyat. Antara program yang bakal diadakan ialah sesi ceramah umum dan berkelompok, pertandingan syarahan serta kempen memasang banner.

“Contohnya, melalui pertandingan syarahan penganjur (penerangan) boleh memilih tajuk-tajuk yang sensasi seperi ’Kerajaan Selangor Zalim' dan `Di Sebalik Kematian Teoh Beng Hock’.

“Ini akan memberi peluang kepada peserta meluahkan pandangan mereka dalam membongkar segala penyelewengan kerajaan negeri,” katanya kepada pemberita selepas merasmikan mesyuarat Perwakilan Pergerakan Pemuda UMNO Bahagian Selayang di sini hari ini. - Bernama

Kit Siang: Who cares who’s MCA president?

DAP supremo Lim Kit Siang weighed in on the rumblings from an impending tussle for the MCA presidency, saying that Malaysians cannot be bothered about who occupies the top post in the Barisan Nasional (BN) component party.

This comes a day after MCA president Datuk Seri Ong Tee Keat remarked that there were external parties trying to subvert MCA and oust him as president, giving the impression that he was under siege.

“I regret that Ong continues to imply I am one of the external forces which put him under siege.

“Let me reiterate that I have no interest whatsoever in MCA politics and I am not in the least bothered whether there is a ‘topple Ong’ campaign in MCA or not. Whether Ong or his deputy Datuk Seri Chua Soi Lek becomes president is utterly inconsequential to Malaysians who do not see any difference between the two.”

Lim has been hounding Ong over the scandal-plagued Port Klang Free Zone (PKFZ) project for months, much to Ong’s annoyance, and today accused the transport minister of trying to claim credit for exposing PKFZ details at much personal risk.

“Ong wants to be a hero without heroism,” said Lim. “If he is going to be toppled as MCA president and transport minister for revealing less than 10 per cent of the PKFZ scandal, why doesn’t he go all the way … expose 100 per cent and accept the consequences of such a principled and courageous act.

“I am prepared to support him to the hilt even if it means consolidating his position as MCA president and transport minister.”

He also offered to lodge a police report over news that Ong had received death threats, if Ong failed to do so himself within 48 hours.

“I will lodge a police report to protect Ong’s life and ensure that the dark forces of the politico-business underground does not compromise the integrity of the government and Cabinet.”

The Star newspaper today reported that Ong had received a threat that said: “If you are wiped out from this world some day, you should know why this happened.”

Ong’s deputy and bitter rival, Dr Chua, also accused Ong of trying to portray himself as a “hero” over the PKFZ debacle.

In response to Chua’s comments, Ong told reporters today: “Let him talk, let him talk.”

When asked if he had already lodged a police report over threats to his personal safety, Ong told reporters: “I have been doing what is needful. I have been keeping in touch with police.”

The Malaysian Insider understands that supporters of both Ong and Chua are gearing up for a fierce battle that could culminate in a fresh vote for the MCA leadership.

Police report filed against 'Beng Hock' blog

Selangor executive councillor Ean Yong Hian Wah today lodged a police report against a blog that accused him of being involved in corruption and his colleague Ronnie Liu of siphoning off state funds in 2008.

NONESpeaking to reporters before lodging the report at the Shah Alam police district headquarters, Ean said the blog "wanted to shift people's attention from the controversial death of his political aide Teoh Beng Hock."

The blog had accused Liu and Ean of having a hand in Teoh's death and that they were involved in corrupt practices, particularly with state funds meant for the MCA-held Sungai Pelek constituency.

"The blog also tried to implicate me in Teoh's death by accusing me and Liu of forcing him (Teoh) to collude in unlawful activities.

"These are all lies as Teoh never worked for Liu and he was never involved with the Sungai Pelek allocation affairs," he said.

NONEEan, who is also mulling filing a report with the Malaysian Communication and Multimedia Commission, also claimed that the blog was aimed at "disrupting unity among Pakatan Rakyat partners."

Liu, who initially did not agree to lodging a police report against the blog, said he agreed to it following the "advice he received from his DAP colleagues."

"I did not plan to lodge a police report because I don't believe in the police. I also stressed before that I would not report to the Malaysian Anti-Corruption Commission (MACC) either as I have lost faith in them.

"But my friends from DAP and the top Pakatan leadership said that I still need to lodge a report to avoid our enemies from manipulating the facts...and to show that I don't have anything to hide," said Liu, who has repeatedly denied the allegations.

Liu: I am an easy target

NONEThe blog titled 'Truth for Teoh Beng Hock' had posted documents to back its claim that 84 'projects' amounting to more than RM200,000 in the Sungai Pelek constituency were awarded to Liu's special assistant and Selayang councillor Wong Chuan How.

Sungai Pelek is a state seat held by Yap Ee Wah of the opposition Barisan Nasional.

Yesterday, Liu and Ean again reiterated that they have been defamed by the blog which alleged that the late Teoh had proof of the duo's corruption.

Teoh was found dead last week at the fifth floor landing of Plaza Masalam, Shah Alam, several hours after being questioned at the Selangor MACC on the 14th floor of the same building.

NONEToday, Liu claimed that MACC will take action against him and Ean "although no report was lodged by anybody" over the allegations in the blog.

He also labelled himself as an "easy target for false allegations" as he is the state exco for local development.

Meanwhile, Shah Alam PAS parliamentarian Khalid Samad, who was also present, accused Umno and BN of trying to wreck Pakatan's unity in Selangor by targeting DAP.

"We all know that all the state fund expenditure has been posted on Liu's blog and this shows that the current state government now is more transparent," he said.

Teoh sudah mati/pengsan sebelum jatuh! - Dr. Boon Chye

"Kita sudah dapat maklumat yang boleh memberikan gambaran tragedi kematian Teoh,"Kata Dr. Lim Boon Chye,selaku pakar bedah dan Ahli Parlimen Gopeng dalam ucapan beliau pada ceramah PR di Gopeng malam tadi.

Menurut Dr. Lim,pengalaman beliau mengenai kecederaan teruk pada badan sebelah kanan Teoh iaitu bahu,pinggang dan kaki kanan dapat memberikan petunjuk bahawa beliau telah "Pengsan atau mati " sebelum terjatuh atau dijatuhkan dari bangunan tersebut,kata Dr. pakar tersebut.

"Selalunya mereka yang membunuh diri akan meronta-ronta sebelum sampai ke bumi,dan dengan spontan akan menggunakan kedua-dua tangan dan kaki sebagai tempat bertahan, serta muka mereka juga akan mengalami kecederaan yang teruk.kedua kaki dan tangan mangsa akan mengalami patah yang begitu teruk." katanya.

"Tetapi berlaku sebaliknya,pada mayat Teoh yang hanya mengalami kecederaan yang teruk pada sisi kanan badan beliau saja,dan ini memberi gambaran bahawa beliau tidak meronta semasa jatuh.Perkara begini terjadi hanya kepada mangsa yang dibuang dalam keadaan pengsan atau pun sudah mati sebelum itu." Tegas beliau.

Untuk itu,beliau meminta pihak yang telah diamanahkan bagi menjalankan siasatan terhadap misteri kematian Teoh agar telus dan melaporkan hasil siasatan kepada rakyat di negara ini.

ISA: Abdullah disaran sertai Pakatan Rakyat

Mantan Perdana Menteri, Tun Abdullah Ahmad Badawi disaran menyertai PAS atau Parti Keadilan Rakyat (KeADILan) segera setelah sekata dalam usaha memperjuangkan pemansuhan Akta Keselamatan Dalam Negeri (ISA) kata Ahli Jawatankuasa PAS Pusat, Haji Mohamad Sabu.

Menurutnya, walaupun sudah pencen daripada sebarang jawatan kerajaan kata-katanya masih berbisa dan merupakan tamparan hebat pada Umno dan Barisan Nasional (BN) apabila turut menyuarakan ketidak setujuan terhadap akta zalim itu.

"Pak Lah jangan berlegah lagi marilah bersama PAS atau KeADILan kerana suaranya pasti berbisa jika berada dalam Pakatan Rakyat. Jika bersama Umno dan BN apa yang diperkatakan ditolak mentah-mentah oleh kepimpinan sekarang, " ujarnya ketika berceramah di Taman Guar Perahu, Penanti semalam.

Baginya, jika Tun Abdullah masih kekal dalam Umno pastinya Umno sendiri akan melebelkan dirinya sebagai pengkhianat tambahan lagi datuknya, Tuan Guru Abdullah Fahim merupakan aktivis pergerakan Islam sehingga membawa penubuhan PAS pada awalnya.

Lebih-lebih lagi rakan seperjuanganya, seperti bekas menteri dan bekas pemimpin MCA, Dato' Chua Jui Ming serta terbaru bekas Naib Presiden MIC, S.S. Subramaniam mengumumkan menyertai KeADILan.

Kata Haji Mohamad, dua orang ternama dalam parti MCA dan MIC tidak teragak-agak membuat pilihan tepat apatah lagi Tun Abdullah yang dimalukan agar turun lebih awal daripada tarikh persaraan sebenar setelah didesak oleh orangnya sendiri setelah menunjukan prestasi terburuk dalam pilihanraya umum ke 12 lalu.

"Pak Lah buatlah pilihan yang tepat di usia yang ada kerana jika bertanding jawatan Tok Siak pun belum tentu menang kerana Umno dan penyokongnya tidak pandang pengalaman tetapi kuasa. Siapa yang berkuasa dipuji tapi bila pencen atau jatuh dalam politik diketepikan, " tambahnya dalam program Pemansuhan ISA anjuran Dewan Pemuda PAS Negeri Pulau Pinang.

PKR jangan terperangkap dengan permainan politik katak


Negeri Perak huru-hara gara-gara perbuatan tak bermaruah sang katak. Sehingga hari ini, politik negeri Perak masih dalam keadaan tak menentu. Kisah dan ceriter yang konon nyer DUN Perak akan dibubarkan sudah banyak kali kita dengar tapi setakat ini, satu pun belum menjadi kenyataan.

Dan....belakangan ini, isu pembubaran DUN Perak sering dikaitkan dengan katak-katak durjana tersebut. Mereka sering bermain aci-cop ala chipsmore untuk meng'GEMPAR'kan suasana politik negeri Perak. Now you see them....now you don't!!! Mereka seolah-olah membuat kita berteka-teki. To tell you the truth, rakyat Perak sudah fed-up dengan permainan aci-cop dan teka teki mereka itu. Yes.... yes.... yes..... fed-up.... getik.... meluat!!!

Apakah mereka ingin menjadi katak double-sided tape? Gasak habuan sebelah sana dan cuba pula gasak habuan sebelah ini. Mungkinkah satu side of the tape sudah tidak berkesan lagi....?? Kerana.... dari ceriter buah mulut orang.... konon nyer UMNO telah menipu mereka hidup-hidup. Janji nak bagi upah melompat tapi habuk pun tarak. Entah ler..... tarak ke atau tarak cukup??? Wallahualam.... Betul cakap orang-orang tua.... "orang tamak selalu rugi."

Apakah mereka sudah tak cukup soru sehingga terpaksa guna the other side of the tape. Yakni.... kali ini mereka cuba bermain aci-cop untuk mengena pihak yang dulunya mereka khianati iaitu PKR. Mungkinkah ada dealing dibuat oleh sang katak untuk mendapatkan habuan bagi melepaskan kerusi yang mereka sandang sekarang. Dalam keadaan terdesak dan apabila merasakan yang diri mereka sudah tidak ada harga lagi baik bagi UMNO maupun PKR, apa-apa pun mereka boleh dilakukan untuk menjaga kepentingan diri. Ini lah sikap sang oportunis.

Lantaran itu, PKR mesti berhati-hati dan bijak dalam membuat percaturan politik mereka apabila berhadapan dengan sang-sang katak oportunis ini. Once bitten, twice shy... Harap-harap PKR tidak akan terpedaya dengan permainan dan terlior dengan tawaran yang mereka buat. Who knows.... ini mungkin juga satu trap to tarnish PKR's reputation. Dan.... jika betul DUN Perak bubar nanti, habis PKR..... terduduk dalam pilihan raya tersebut. Jangan sekali-kali terjebak dalam gejala tak bermaruah ni..... padah nanti!!! Kalau dah hilang integriti..... akibat nyer mati ler PKR!!!

Pedulikan katak-katak tersebut!!! Concentrate more untuk menyusun dan memperkemas parti di semua peringkat agar menjadi lebih kukuh dan lebih bersedia untuk menghadapi kemungkinan sekiranya DUN Perak dibubarkan nanti seperti yang heboh diperkatakan dan dikhabaranginkan.... Forget about the kataks!! Anggap saja katak-katak tersebut HISTORY..... yang tak ada nilai sejarah walau satu duit pun!!!

Contrast this to that other old veteran Ku Li, who is advocating greater racial and national unity through encouraging change and acceptance of a more egalitarian Malaysian society. On the other hand, Mahathir seeks to rejuvenate his waning influence through a divide-and-rule strategy.

Mahathir's recent comments are clearly racist, revealing his true character, and I have lost every respect for this man who, in my opinion, has taken the nation to ransom. Why should a man like him keep destablising the country when his projects like the crooked bridge are abandoned?

Always Malaysian:
Some quarters argued that Dr M has honed his 'divide-and-rule' tactics into a perfect art. But this may no longer be effective with the emergence of the new and free media.

Nevertheless, the public needs to be educated and enlightened on how such a strategy is being employed from time to time, regardless of whether the ruling coalition or opposition partnership may be using it. This is part and parcel of further enhancing the democratic process in the country.

Will we see a series of articles on this issue in the foreseeable future on the local and even foreign case studies of this devious art of 'divide and rule', the modus operandi of its proponents, how to detect such its manifestation, how can the public combat this socio-political menace and avoid being divided to the nation's detriment, etc?

Exposure is needed so that the public will be better informed when making political choices through the ballot box.

Ong: Maybe the MACC advisers are not resigning because they want to follow Tun Mahathir's example. For many years, Mahathir has been complaining that although he is the Petronas adviser, his advice is never sought, and when he takes the initiative to give advice, his unsolicited advice is ignored. These MACC advisers obviously remember Mahathir's slogan "Pimpinan Melalui Teladan".

However the MACC advisers cannot be compared to Mahathir if both of their work performance are evaluated. When Mahathir sees something in Petronas which he feels is not right, he takes the initiative and springs into action with his advice and criticisms despite that they are likely to be ignored.

All the MACC advisers may be a lot younger than Mahathir, but unfortunately they appear to be a lot more lethargic compared to him. Their eyesight are not so good. What the general public can see, these advisers cannot see. Their hearing are also impaired. They cannot hear the public pleas to them to start acting their roles as advisers and watchdogs. They only manage to hear when such pleas turn to shouts.

What a pity - if only these MACC advisers follow Mahathir's leadership by example. They do not also follow Mahathir's example of springing into action even though knowing that any such action is just for show.


On Cabinet approves royal commission

Disappointed: A royal commission has been approved by the cabinet to look into the cause of Teoh Beng Hock's death? No! It is only there to look into the MACC's interrogation methods.

So, who will look into Teoh's cause of death which is what Malaysians really want to know? The court-appointed magistrate's inquest findings will only represent the judgment of a single person instead of a team of people from the royal commission. There is something wrong somewhere!

GH Kok: In view of Teoh Beng Hock's death and the pattern of MACC assault on Selangor Pakatan Rakyat government prior to that, we also hear of mysterious attempts to sabotage the Penang state government through the Kampung Buah Pala issue.

The pattern is slowly emerging of an elaborate and systematic attempt to undermine the Pakatan state governments by unseen hands working through federal agencies and other parties.

There are also theories that Najib plans to call for a general election in 2010 and therefore the pressing need to undermine and weaken the Pakatan before calling for the election.

It seems that all available weapons are now being used against Pakatan. There seems to be no limits. It started with Perak and now the campaign is in full flight simultaneously in Penang, Selangor and Kedah.

In view of this assault, it appears that Teoh Beng Hock is but a collateral damage. How many more victims of this "war" are we going to see? We the rakyat of Malaysia must stand firm against this assault.

We must keep our eyes and ears open and not participate in questionable activities. We must report to the press (online press) any suspicious happenings in our area or in the course of our daily life. Let the light shine on all happenings in every nook and cranny of this country.

The federal civil servants, who are always suppressed and bullied by their political masters, may they too shed light on all such abuses of their agencies. Bring it all out into the open and let the whole world see the truth. Courage is needed for the price of democracy is eternal vigilance.

Should Anwar have Access to the Prosecution’s Evidence?

After all, if I were confident in my case and knew that I could argue my heart out on the merits and win a conviction for the good and true folks of my little town, then why should it be a cause of concern if the defendant knows what evidence I have?

I often contemplate the parable of the college professor who shows his class an empty glass container. He then places a number of large rocks inside the container and asks the class: “How many of you believe this container is full?” Of course, most in the class raise their hands. With that the professor continues to pour increasingly smaller varieties of rock, from pebbles to gravel to sand into the container, at each interval asking the class the same question. Eventually the class, marveling at the amount of material that the professor is able to fit into the container, is dumbstruck. At the end of the demonstration, the professor finally concedes that the container is, in fact, full. He then pointedly asks the class about the meaning of the demonstration to their lives. No hands go up. Finally, in the rear of the class, a normally timid young woman raises her hand. The professor calls on her, and in a trembling voice she says: “Our lives are the container and in order to fill our lives we must always start with the big rocks. If we do that, we will always find room for the smaller rocks.”

More about that in a bit.

Perhaps it might be useful to view Anwar’s current legal struggle in the light of standards that exist outside of the Malaysian legal system. Of course, we as citizens of a nation can only work within the framework of the legal system of our country or state. Each sovereign has the absolute authority and prerogative to create laws that suit its people and that somehow reflect its legal history, its constitution and its overall mentality toward justice in general. And, certainly, Malaysian law should not be compared with, and is in many ways entirely dissimilar to, U.S. law. I understand this and am in no way suggesting that Malaysian law should be in lockstep with American legal precepts. As a former prosecutor in the U.S., I have always marveled at the many attractions in Malaysian law, not the least of which is the ability of the government to appeal acquittals and to seek upward modifications of sentence. Similarly, it certainly creates loads of new opportunities for closing arguments when the prosecutor is allowed to suggest that the defendant’s silence, under circumstances in which a reasonable man would be expected to cry out his innocence, is strongly suggestive of guilt. I mean, from the state’s standpoint, what’s not to like?

However, the present situation and battle being fought by Anwar is one that normally does not appeal to the majority of armchair legal quarterbacks who enjoy the pitched battle of actual trials: what we sometimes refer to as “the guilt phase”. This time, it’s the nitty-gritty stuff: evidence. Anwar is now in the midst of what is referred to in my state as a “motion in limine”. A motion in limine is any request, by either side, that may be raised prior to trial. These normally are critical evidence motions, often involving issues associated with providing evidence as set forth in the relevant rules. What Anwar is dealing with now, and which notably the government is appealing, is a decision regarding “discovery”. Discovery is the term used in U.S. law to refer to the obligation of the parties in litigation (the State and the Defendant in a criminal case) to provide each other with certain information. Both have obligations to disclose some portion of their intended evidence.

My state of is no different than the other 49 states in its promulgation of criminal procedure rules that are strongly – and increasingly - deferential to the rights of criminal defendants. There are a number of reasons for this, primarily the U.S. constitution’s grant to the accused of the right to a fair trial. Beyond that is the requirement, accepted under Malaysian law as well, that governments prove guilt beyond a reasonable doubt. The implication of this burden of proof on the discovery process is the widely held perception that the defense can only illuminate such doubt when it has the benefit of assessing the evidence. Of course, there is the history underlying the formation of the 13 colonies: that a government with unbridled powers is a potential obstruction to liberty throwing back to touchy colonial issues such as freedom of worship, and taxation without representation.

Honestly, as a prosecutor, I never cared much for the requirement to turn over my case to the defense. Yet, I acknowledged that I represented the government: a well-oiled machine that had police, scientists, resources, credibility and, ultimately, the commonly-held belief within society that anyone who is charged with a crime is, well, probably guilty. Remembering that the international symbol of justice is the blindfolded woman holding a scale, I always had to slap myself to remember that my disclosure of the state’s evidence went a long way in ensuring that balance. After all, if I were confident in my case and knew that I could argue my heart out on the merits and win a conviction for the good and true folks of my little town, then why should it be a cause of concern if the defendant knows what evidence I have? And, if his having the evidence allows him the opportunity to construct a lawful defense, then, at the end of the day, he has achieved his constitutional privilege of a fair trial. Don’t misunderstand me. I loved to win, perhaps too much. One of the things I often overlooked and that, in fact, ultimately drove me out of criminal practice, was my slap-in-the-face learning moment that it wasn’t how many notches I had in my gun belt It was all about letting the system work; about remembering that a man’s life and family are riding on judicial outcomes.

But it’s not my light bulb moment that matters now. It’s Anwar’s situation.

So, what is Anwar asking for? And here, I do have to do a little tit-for-tat comparison, so please excuse. Under my state’s law, the state must disclose all evidence that it intends to use at trial. It must also turn over all exculpatory evidence (evidence tending to suggest the innocence of the defendant). I, as prosecutor must also provide the names and reports of all experts I intend to call as a witness in the state’s case including the results of any tests or assessments done; the statements of any witnesses I intend to call, any tapes and recordings of statements made by the defendant, any information I have that tends to impeach the credibility of state’s witnesses, including prior inconsistent statements, relationship with the prosecution and evidence suggesting a character for untruthfulness. Significantly, all the above-mentioned items must be disclosed without request. They are what we call “automatic discovery”. It would appear that Anwar’s requests do not exceed what the majority view in U.S. law would consider stuff to which he is entitled without even having to ask.

The question I have then is a rhetorical one perhaps, yet one that must would appear to underlie the Anwar case at this point. Why isn’t it automatic discovery in this case? There is nothing fundamentally unjust about Malaysia. Its legal system is largely founded upon precepts of the British common law system, as is the American system. Similarly, there is nothing magical, mystical, anti-Asian, overly liberal, American or even western about American rules of discovery. They are simply a means to learn the truth in the judicial setting and to do so in a forum that offers a fair opportunity for both parties to access and benefit from that truth. And, in a country whose judicial system seeks to demonstrate its independence and to dispel suggestions of impropriety, aren’t the truth and the search therefore its best friends? Shouldn’t they be? Isn’t the best response by government to allegations that Anwar’s trial is somehow politically motivated – in the words of the old casino metaphor – to simply lay its cards on the table? To throw the chips in the air and let them fall where they may? Ultimately, as strong as is the belief that one who is charged is guilty, is the belief that one who hides something has something to hide. And, at the end of the day, all legal systems are based on such broad notions found within natural law.

I am, perhaps, overly optimistic and believe that it is in the best interest of a government to ensure that, as the old legal axiom goes: “justice must be seen to be done.” Malaysian discovery rules need not become clones of those followed in the U.S. Nevertheless, at stake here and in every courthouse in every nation, town, county, parish, district or province in the world is a search for the truth and the ability of all sides to assist in finding it. Remember the parable of the professor and the glass jar? This is the big rock with which we must start when filling the container of a healthy, unassailable judicial system. When we have loaded in the search for the truth, we will find that rules of discovery that assist in that search are somewhere between the gravel and the sand. They will fit quite nicely. Then the jar will be full.

UMNO tidak ketepikan bumiputera....Tapi tipu dan musnahkan bumiputera...!!!!!!

SEMPORNA 25 Julai - Rakyat dinasihatkan tidak terpengaruh dengan dakyah sesetengah pihak bahawa UMNO sudah mula melaksanakan dasar yang dilihat mengabaikan bumiputera.

Naib Presiden UMNO, Datuk Seri Mohd. Shafie Apdal berkata, kesungguhan Perdana Menteri, Datuk Seri Najib Tun Razak yang juga Presiden parti dalam membantu bumiputera tidak pernah berubah melalui beberapa dasar yang diumumkan.

"Jika ada orang yang mengatakan UMNO sekarang sudah mengetepikan dasar membantu bumiputera, itu mainan politik semata-mata," katanya.

Beliau berkata demikian ketika berucap merasmikan Mesyuarat Perwakilan UMNO Bahagian Semporna di sini hari ini.

Hadir sama Timbalan Ketua Bahagian UMNO Semporna, Datuk Nasir Tun Sakaran dan Ahli Parlimen Kalabakan, Datuk Ghafur Salleh mewakili Badan Perhubungan UMNO Negeri Sabah.

Shafie menjelaskan, keikhlasan Najib untuk membela nasib bumiputera terbukti apabila meluluskan peruntukan RM555 juta bagi negeri Sabah baru-baru ini.

"Saya minta RM775 juta tetapi tidak sampai dua minggu, beliau beritahu saya RM555 juta sudah diluluskan untuk pendidikan anak-anak bumiputera.

"Ini bermakna dia meluluskan tiga perempat daripada peruntukan yang saya minta,'' ujar beliau.

Shafie berkata, dalam UMNO 'berkeras' untuk menjayakan agenda Melayu dan bumiputera, ia tidak bermakna keperluan kaum-kaum lain akan dibiarkan.

"UMNO ibarat sebatang pokok besar yang rendang serta menjadi tempat berteduh untuk semua, baik yang kecil atau besar,'' katanya.

Beliau menambah, bagi membolehkan UMNO meneruskan dasar membantu bumiputera, parti itu mesti kuat dan bersatu padu.

Katanya, perpaduan dan kerjasama di kalangan ahli adalah kunci utama kepada kejayaan parti itu untuk terus mendapat kepercayaan rakyat pada pilihan raya akan datang.

"Sebenarnya perpecahan kita hanya memberi kelebihan kepada pembangkang.

"Mereka sebenarnya tidak ada apa-apa dan ini jelas terbukti dalam kekalutan yang berlaku di negeri yang diperintah oleh pembangkang," katanya.

MANSUH I.S.A VS PR0-I.S.A - 1 OGOS ADALAH HARI REFERRENDUM RAKYAT

Parti Islam Se-Malaysia (PAS) mengucapkan tahniah kepada Gerakan Mansuhkan ISA (GMI)yang akan mengadakan Himpunan Mansuhkan ISA terbesar pada 1 Ogos minggu hadapan di Ibu Negara.

Kesungguhan GMI ini akhirnya berjaya membuatkan Pendukung Akta Keselamatan Dalam Negeri (Pro-ISA) tercabar untuk melakukan Himpunan yang sama pada hari dan waktu yang sama (2 petang).

PAS melihat bahawa inilah peluang untuk Kerajaan melihat kesungguhan rakyat terhadap Akta zalim ini. Pada 1 Ogos ini seluruh rakyat diseru untuk keluar rumah dan menyertai referendum rakyat ini. Inilah hari Referendum ISA yang terbesar pernah berlaku dalam sejarah negara dibawah kepimpinan Perdana Menteri yang baru. Dato’ Seri Najib Tun Razak.

Jika anda menyokong pemansuhan ISA, maka berhimpunlah bersama GMI di SOGO, Masjid Jamek dan Masjid Negara sebelum berarak beramai-ramai ke Istana negara dengan pakaian Hitam atau Merah.

Jika anda menyokong kumpulan Pro-ISA, maka hadirlah bersama mereka di Pasar Seni dan kemudian berarak ke Istana Negara dengan pakaian putih.

Maka pada hari itu, Istana dan Kerajaan akan melihat kelompok manakah yang mendapat suara referendum yang majoriti.

Jika Kumpulan GMI lebih ramai maka Kerajaan haruslah mansuhkan ISA serta merta, begitu juga sebaliknya.

PAS yakin, GMI mampu mengumpulkan lebih dari 100 ribu rakyat untuk mendesak Kerajaan memansuhkan ISA.

PAS berharap agar pasukan Polis bertindak bijak dan tidak mencetuskan provokasi supaya kedua-dua kumpulan ini dapat berhimpun secara aman.

Liu dedah butiran perbelanjaan DUN Sg. Pelek

Exco Kerajaan Selangor ini nafi elemen salah guna dana

PETALING JAYA: Exco Kerajaan Negeri Selangor, Ronnie Liu petang tadi mendedahkan butiran perbelanjaan awam bagi kawasan Dewan Undangan Negeri (DUN) Sungai Pelek, sekali gus menafikan wujudnya elemen penyalahgunaan dana kerajaan.

Sambil mendakwa dokumen-dokumen yang dimuatkan dalam blog http://t4tbh.blogspot.com yang muncul sejak kelmarin, sebagai maklumat palsu, pemimpin DAP itu memberitahu, beliau mempunyai rekod butiran perbelanjaan dan bukti dalam bentuk foto.

"Kami menggunakan prosedur yang telah digunakan oleh kerajaan Barisan Nasional (sebelum ini).

"Dan, kami melakukan lebih daripada itu dengan mempunyai bukti foto," kata beliau sambil menambah, kesemua program yang dianjurkan memerlukan kelulusan pegawai-pegawai daerah terbabit sebelum dilaksanakan.

Liu yang juga Ahli Dewan Undangan Negeri (ADUN) Pandamaran mendakwa pengendali blog berkenaan telah memalsukan butiran yang diperoleh daripada blognya (www.colour-blind.org) bagi menggambarkan pemimpin-pemimpin DAP sebagai korup.

"Blog itu mendakwa lima hingga 10 peratus peruntukan disalurkan kepada ADUN ataupun Ibu Pejabat DAP (sebagai komisyen).

"Ia satu pembohongan. Jika St. John's (Ambulans) memperoleh RM30,000 daripada saya, mereka akan menerima RM30,000. Tidak satu sen pun kurang," kata beliau kepada pemberita di sini.

Sambil menolak beberapa perkara yang ditunjukkan oleh blog berkenaan, Liu berkata, wujud kesilapan yang cukup ketara termasuk perbelanjaan bagi program yang dijalankan pada Januari dan Februari tahun lalu.

Pilihan raya umum diadakan Mac 2008.

Banyak aspek yang digambarkan oleh blog berkenaan adalah sesuatu yang sengaja "dibuat", antaranya pembelian hamper bagi Jawatankuasa Keselamatan dan Kemajuan Kampung Seberang Perai, Pulau Pinang.

Ketika ditanya mengapa beliau mengambil berat soal peruntukan kerajaan untuk bahagian DUN Sungai Pelek, Liu berkata, ada ADUN yang dikhaskan untuk menyedia kerusi Dewan Undangan Negeri yang dimenangi oleh Barisan Nasional.

"Ini diputuskan oleh Exco Kerajaan Negeri kerana kami tidak percayai ADUN Barisan Nasional," katanya.

Liu juga menjelaskan sebab ahli Majlis Perbandaran Sepang, Wong Chuan How merupakan penerima kebanyakan bayaran di DUN Sg. Pelek.

"Wong bukan merupakan kontraktor. Kadangkala cek dihantar kepada pusat khidmat saya terlebih dahulu dan Wong merupakan pemilik akaun bagi pusat khidmat saya.

"Ini berlaku apabila kami tidak boleh mengeluarkan cek secara langsung seperti bayaran bagi makanan, kanopi dan sistem PA," katanya.

Wong yang turut hadir pada sidang media itu berkata, beliau juga merupakan pembantu khas kepada Liu bagi kawasan Sungai Pelek dan Setiausaha DAP Cawangan Sungai Pelek.
